That's not accurate. Courts have ruled that the rights to remain silent and to not self incriminate.. protect the person from having to give their password of swipe code.
Agreed, though keep in mind that what happens at a border crossing might be markedly different.
 
Rider didn't put the gascap on because he wasn't interested in sticking around to talk to the guy that jumped out of the SUV. Based on the motion of the camera, it is a camera on a stick off the back of the bike. Gyroscope stabilized so it stayed upright as bike tipped. Software hides the stick. Camera records a sphere and you can select what appears in the finished video in software.

Interesting string of events. This could go either way for the cops. Tackled because they thought it was stolen (it wasn't), stunt driving and flight from police. All of those disappeared and he got license tickets. Probably a case of cops or ALPR screwing up and they got lucky that rider had issues. Now, if rider was innocent, they could easily post the previous ten minutes of video. I suspect that video won't help the riders case. Given the arrest, I assume the cops have a copy of the whole video?

Are any cameras recording encrypted video yet? Make the card useless without the password. Once you have processed on a computer (using the password to decrypt), exported video would be normal. Solves the issue of self-incrimination.
If I caught a crash on my dash cam I'd be reluctant to give the police the SD card. While I'm a prudent driver a magnify glass look at a dash cam could be expensive.

I wouldnt give up the card either unless forced. I'd be happy to provide the video. If they were worried about chain of custody, I could put the sd card in my phone to pull off the one important segment and send the file to the cop.

Timely article on password protected devices. Interestingly, in this case, judge said police could destroy or return phones. Wtf? They seized them to look for evidence, found zero evidence and they can destroy thousands of dollars of your stuff?

Tl: dr you don't need to give up password and police are not allowed to try forever to guess.

The destruction part is 100% wrong.

What if there was something on the device that could prove you innocent. If you can't remember what you did two weeks ago a quick look at your credit / debit card activity could remind you.

I wonder about the limits of search warrants. I know a couple of people in R&D and what would stop a searcher from noticing a development and passing it on to someone he knew that worked in a related field.

Could a stock market tip get generated from searched business materials?

I have no problem with the authorities accessing materials that are destructive to humanity, kiddie porn, murder plots etc but where is there a safeguard against theft of legitimate data or using it inappropriately. The authorities have urinated in their own wells.

Back when he was PM Chretien was accused of a shady real estate deal by IIRC Preston Manning. Chretien had the RCMP examine the documents and they were declared to be falsified or forged. The documents were ordered destroyed. The PM appoints the RCMP Commissionaire. Power flows downhill.

If someone slandered me and the documents were proven false I would have them framed and hung on my office wall. Anytime the false accuser came up with another complaint I would point to the previous documents and say "Oh you mean like last time."
 
Like insurance, if you get hurt in the commission of a crime, F you, everybody else should get a pass. Cops weren't going to show up in time and courts were sure as hell going to release bat guy in less than a day. Getting a few steps away from the crime scene doesn't change the rules. Probably something like out of sight to avoid legal street justice.

Laws regarding photography of people are different in Quebec than they are in pretty much the rest of Canada. I don't think that a trespasser can really claim that they have a right to privacy on your property. As to the comment about defamation, I really don't think so. Especially not if all that you do is present the video without comment, but making comments about rather obvious activities shouldn't be an issue.

Ahahaha. The cop saying they will investigate and press charges is beyond laughable. There is no bleeping way that happens very often.

"If you get some proof that somebody might have stolen something, call the police, give that proof to the police," he said. "We'll do the investigation, bring that person to justice and file some charges."

As for being the communications officer, he needs to be canned. So passive (eg. might have stolen something), very pro-criminal ("You cannot post the images yourself because you have to remember, in Canada, we have a presumption of innocence and posting that picture could be a violation of private life," said SQ communications officer Lt. Benoit Richard.), just an all around idiot. Don't do our job, don't show the world the number of times we aren't doing our job, don't assume people stealing from you are stealing from you, etc.

Sadly once the fellon has retreated you have to stop protecting yourself. He comes back later to finish the job and will be better prepared.

Tourism Canada should be advertizing "Come up here and steal some souvenirs"
 
Finally enforcing the law re: these idiots taking over major arteries. I think the footage of the shuttling of coffee + donuts to them by his charges earlier in the week was the final straw with the police chief.

The story i heard is cops didn't buy the coffee. A supporter bought supplies and cops prevented more people from going on the bridge to deliver it but agreed to do the delivery themselves.

Still, a welcome softening of the thin blue line. My concern was the protest being seen by 401 traffic and the distraction causing a collision.

If they really wanted to deal with driver distraction then they'd force ad companies to tear down all the animated billboards along The Gardiner.
