@Paul1000RR would that even work? I imagine the salesman would call the bluff.. Hahaha! I'm okay if they even give me in-store credit. Could buy boots, jacket and a shark helmet (I love modulars)

What bluff? Put the name up and give them the link. Cause enough of a problem and they'll give it back

**** tell em you'll post it on every message board known to man and you'll bump it on a daily basis until you get your deposit back. Also you'll tell the story to every human being willing to listen.

How well do you understand the contract and whether or not the dealer will have damages as a result of you not taking delivery of the bike?

Deposits are not to be a winfall for dealers when buyers walk. They are to be used to cover damages incurred from having to buy inventory that they would not have otherwise acquired.

If you believe that the dealer will not have damages if you walk and that they will cancel the bike delivery and keep your $500, then that is offside.

If they're doing that and they won't refund your money or help you out with a credit, then yes, I'd expose them and I would also make sure they don't cancel that bike.

You've paid them $500 to acquire the bike for you. If they don't do that, they need to give you your $500 back.

You keep posting here and asking questions that are taking you down the wrong path.

Ask about a credit first. If they don't do that, understand your contract and use your rights within it (make them follow up with acquiring the bike and make them sit on it for as long as your rights allow before canceling without penalty) to get leverage.

They will negotiate if they will need to tie working capital up in a bike they may not have a buyer for.

Stop dancing around views and speculations and start understanding what your contract says and how you can use your rights within it to get a better outcome for you.
 
My guess is that theyre only telling you that your deposit is nonrefundable, as per policy, because they think that you believe that if nonrefundable and final is written on the contract, that it is actually true.

My last comment on this: Do not cancel delivery of the bike until you have a resolution that youre happy with. Understand what your contract says about failure to finalize the sale too.

Best of luck OP. You will get a good outcome if you approach this in a reasonable manner and if the dealer is not a skoundrel.

They didn't special order the bike for this guy. He's put a deposit on one that was already enroute or part of a scheduled shipment. They will have no issue selling it to someone else.... Keeping the deposit is a dick move IMO.. using policy as the excuse doesn't make it any less so!
 
I've completely forgot about the one thing that originally had me really irked about this whole contract. The salesman just pointed out the finances and everything and pointed to the signage. He had not got the proper model OR the proper colour which had me really livid in the beginning. He told me "We'll just change it". I told him I want a new contract so there's no ambiguity or discrepancy so I get what I want. He says "It's okay. Don't worry. It'll be okay. We'll just change it"

Anyway. I'm going to post the back of the contract to see if I can get some help here.

Skipping the first point since it's not a trade in vehicle.

TAXES AND FINANCING.
You agree to pay the dealer an amount equal to any increase in taxes payable relating to the purchase of the vehicle, between the date of this agreement and delivery of the vehicle to you. Should the amount of tax payable be reduced, the dealer agrees to deduct this amount from the total to you.

You agree that you will be responsible for any damages suffered by the dealer if a financing contract cannot be arranged because of any default or misrepresentation by you.

LEGAL OWNERSHIP AND PURCHASER'S OBLIGATIONS
Legal ownership of the vehicle shall not pass to you until the entire purchase price has been paid in full. You agree that until that time, you shall;
(a) maintain insurance on the vehicle with the dealer named as the beneficiary in the event of a loss;
(b) not sell or transfer the vehicle to anyone else;
(c) not allow any lien or interest to be taken in or against the vehicle;
(d)not allow the vehicle to be used in the commission of any illegal act; and
(e) reimburse the dealer for any costs the dealer may incur due to your failure to comply with any of (a), (b), (c), or (d) above.

ACCEPTANCE BY PURCHASER
If you refuse to take delivery of the vehicle when it is made available to you, or on the delivery date specified in this agreement, the dealer shall notify you, by registered mail, sent to your last address known to the dealer, that the vehicle is available for delivery. If you fail to take delivery of the vehicle within seven (7) days of signed receipt of this notice, or if the notice is returned to the dealer unclaimed, the dealer may resell the vehicle with no further notice to you.

When the dealer resells the vehicle, you agree to pay for all losses the dealer incurs. Any deposit or vehicle traded-in may be kept by the dealer to apply against any loss suffered by the dealer. If the loss is greater than the total amount paid as a deposit and the value of the trade-in, you agree to pay the difference to the dealer.

The dealer agrees to provide you with a detailed accounting of the resale and a list of expenses incurred. The dealer shall maintain the right to use any legal means available to collect any sum owing by you under this agreement.

DELIVERY (NEW VEHICLES)
If the vehicle being purchased is a new vehicle which the dealer is ordering from the manufacturer and the dealer is unable to deliver the vehicle to you within ninety (90) days of the date of this agreement, the dealer will notify you in writing. The dealer or you may then cancel this agreement, in writing. This agreement will automatically be cancelled five (5) days following the receipt of notice of delay unless a new delivery date is agreed to in writing. Further delays in the delivery date will result in automatic cancellation of this agreement. The dealer will return your deposit if this agreement is cancelled as a result of this clause and no further obligations will be owing.

It doesn't say anything about a refund if I want to cancel but it does mention I'd have to pay the difference of a resell???

The problem is not the dealers, you decided to buy a new bike. You signed a contract and gave a deposit. Then after thinking about all the things you should have thought about BEFORE signing a contract, you want out. I don't blame you, but you created the situation not them. Be nice, maybe you'll get what you want. Just my .02

Yes, and if they don't go with a refund, it's a $500 vs a $10,000 accident. A mistake I shall never make again...

That being said. I think I'll go for the $500 loss.

Since I have not actually spoken out the final terms on financing, this bike is still on hold

Giving your money back would be evidence of good faith. They are not obligated to do it.
But if they don't, I guess they have bad faith towards the consumer. Maybe people should not shop there, if at all possible.
 
They changed the laws a couple years back. Not only do you lose the deposit, they can demand/and/or sue for more if they sell it for even less.

So I should probably lose out on the $500?

The description in the back says "if I suffer a financial loss I may be compensated"

At the rate this is going this will be a financial loss!

I would think that would apply if the financial loss was due to something the dealership did or could not do - not your backing out on your own.

I contacted OMVIC and they advised me to go in with a written letter to acknowledge my cancellation with my deposit of $500 as the only and possible means of assets lost.

They said the court thing is only if the dealer is going to completely lose out on a sale, and since it's the beginning of the season, they'll probably be able to sell it before the end.

They also said that I should be prepared to lose my $500 as a whole, but agreed with me that an in-store credit might be a wise alternative.

I'm going in tomorrow to talk with the dealership.
 
Homework pays off.

Do searches on kijiji, Yakaz and autotrader and look for sweet deals all across Ontario. Toronto is an expensive place to buy motorcycles. You'll find better deals in other cities. If the deals are really good in another city, rent a pick-up and go get your bike or take the train to the other city and ride the bike home.

Use e-mail and the phone. -- You'd be surprised how much negotiating you can do via e-mail and over the phone with multiple dealers at a time.

My story -- I found a very sweet deal on a Vulcan in London. Then asked a local dealer if he could match the price and save me the train ride to London to pick up the bike. He said yes :)

Regardless -- do your homework and just ask the dealer beat or meet the best deal you've found.

Now the Dad in me will speak -- You wont keep this bike for as long as you think you will. You're 22 years old. Buy a used bike and save your money.
 
So er6ns cost as much as ss bikes? Wow!?! Maybe in the next lifetime .....That and come on....do tell what dealer this is.
 
It's unfortunate that the situation at hand involves a dealer that has affiliation with this website, which is one of the main reasons why I was withholding the name of this dealer.

It is Kahuna Powersports. Apparently the salesman has a record of negative feedback?

My first guess was gonna be Suzuki of Newmarket, but since the bike wasn't sold for 20,000$ and they don't sell kawasaki's that kinda fell apart.

I would imagine that a site sponsor would actually be more willing to work something out with a buyer, only time will tell.

But a lot of people are watching... Your move kahuna ;)
