I read about this last year. Driver was running fast, driving without required corrective lenses, no seat belt.I dont know where this one lies. Leaning towards a driving issue. 60 yo smokes a horse (one of 30 loose) at 3am and gets ejected and dies. Now family is suing for 3m for loss of income and companionship. He was a 60 yo truck driver, how much more income would he have made? Not a clean case for either side. Seeks like an attempt at a financial win in the face of a personal tragedy.

Coming back from Manitoba, in the dark, I saw ovals, going up and down the headlight beams. Probably a moose. An hour or two later I was pulled over by the OPP and given a warning about bears, deer and moose and maybe I shouldn't be going that fast. I've come across loose horses it happens all the time. Hard to see at night, but a lot easier to see than a person walking the road. Horses tend to run parallel to traffic, unlike moose or deer that give drivers no chance as the mostly collide while bolting across the road.
At what appears to be the rate of speed (by where the grey car ended up and the video of it moving) even a motorcycle may have been fatal or serious injuries to the white car driver. If the vehicle speeding had been a bike, the fatality would have gone the other way. Both drivers failed the situational awareness game.

So this will mess up the riders ability to earn income (very few jobs are easy with broken wrists). Does that get dealt with through auto insurance or a civil suit against their general liability insurance? A car was obviously involved but it was parked. Since they have a lawyer, I'm assuming some insurance company will be paying quite a bit for this stupid move.

As long as there's contact you're ok. Lots of bikes have gone down in the process of avoiding a left Turner. If there is no contact, bike gets 100% at fault. If they touch, bike probably gets 0% at fault. Stupid rules but that's where we are.Semantics. I didn't hit the horse/moose/deer. The horse/moose/deer hit me.
