I'm not arguing for punishment before court date. If there is sufficient evidence to convince the JP that he was driving suspended, that should be sufficient to eliminate voluntary undertakings as an option. As a minimum give him a bracelet to wear.
The reason is likely that his license was suspended for Provincial Offences Act charges, while the current charges are under the Criminal Code of Canada. To put it in terms understandable by those raised on American TV, essentially misdemeanour vs. Felony. His current charges could result in a life sentence (20 years). If he was actually under suspension due to a previous charge under CC 320, then he shouldn't currently be walking the streets, let alone driving them, after this incident.
 
I’m at a loss for words…kill a teen and drive off…hide the car…buy an identical car and swap plates and VINs…let car be used for reenactment…15 year search and only a 2 year sentence.

"He said he had a few beers at a friend’s house and decided to drive home. He said he believed he wouldn’t have blown over the limit.

His 11-year-old son was sitting in the back seat.

“During the conversation, Dave Halliburton admitted he struck Lucas Shortreed who was standing in the middle of the road and that he saw Mr. Shortreed at the last second, but it was too late to avoid him,” the agreed statement of facts said.

Halliburton said he knew he struck a person immediately but when his son asked him what happened, he said he struck a deer."

Hopefully the victims family sues him to wipe him out. Although, since he drives neons, there may not be enough there for a lawyer to bother taking the case.

There will be nothing to extract from any civil lawsuit.

The fact he admitted this, held the secret, and actively worked to hide it in pretty much every imaginable way (I wouldn't have thought to buy an identical car) and only got 2 years...is a disgrace to the system.

When does he qualify for parole?

I don't think the wife got enough. Even a few months custody for the elaborated cover up is deserved. Their then 11 year old son is now 25 and dad's in prison. Mom's a scumball. He's got the same last name.

The parents of the victim seem to be satisfied with now having full closure and with it being a small town the Halliburtons will likely have to relocate and will have lost just about everything. Going forward will be tough if employers use Google.

If someone smashes your motorcycle they can replace the bike, restoring you to your previous status. When they kill or maim you or a family member, restoration to previous status is impossible. You have to settle for a consolation award.

Compensation can have a backlash. Someone kills all your children and you get enough money to buy a $5 Million mansion. Someone asks what it cost, do you say $5M or it cost my three children. I'd prefer my old town house and the kids. Basically a form of blood money.

Brutal punishment doesn't seem to be a deterrent if we can go by the USA. It doesn't work because no one thinks they're going to crash into someone and kill them. I don't waste time thinking about where would I take Taylor Swift if she called and said she wanted to go out with me. Should I check to see if my insurance would cover me if I spilled my beer on her $20,000 dress?

Moving on isn't easy but if you don't, you're letting the perpetrators live, rent free, in your head.
 
Coin flip for the proper thread. Highway takeover of QEW at Ford Drive to allow bikes and cars to stunt. OPP wasn't impressed. They figured out some of the operators and started handing out stunting and careless tickets. Three 22 yo's charged so far.

I'm still against the concept of penalties before a finding of guilt (with the exception of when an operator is demonstrably impaired), but these guys were just begging for actual Criminal Code charges and incarceration. When you take the time to actually block traffic, prior to an incident, you're throwing out 9/10 possible defences to charges.

I'm completely against anything that allows a constable to mete out justice without the accused being offered due process. I'm OK with court-ordered restrictions like suspension of a driver's or firearms license, or passport when accused of a serious crime. Every dog deserves his day in court.

If you beat a stunt driving charge (not a plea deal) and ask the judge for damages, they will refuse, then recommend you try small claims court to recover your towing, impound, and incidental expenses are a civil matter.

The only way that you might recover would be if it could be demonstrated that the officer falsified multiple charges, for multiple people, and if he was convicted of it. I’m ok with all that. What I’m not ok with is a keystone cop, like the MC OPPs caught collaborating with tow operators.

The poor sods that got trumped up HTA roadside suspensions, $600 tows and $1000 impound fees only to see cases tossed… where is their justice?

So? Diagonal passages through parking lots are as common as dirt. I had to hammer the horn to stop a grey hair from tee boning me last week. She was cutting diagonally across the lot as if she was boating across a lake. Target fixation on a handicap spot? Parking lots are dangerous places to transit and the insurance regulations are dumber than the drivers.

It isn't the judges who set the sentencing guidelines and if they act outside of them, the verdicts will likely be altered to suit from above.
 
There either will be a celery sale or shortage this week. A semi with a load of the stuff tipped on the 400 Southbound at Hwy 9. 400 was closed from about 10:00 AM to 3:30 PM. It is purely my assumption he was westbound on 9 and took the cloverleaf too fast.

We were too fast to smirk at the long line of southbound traffic as we headed north. That changed to a frown when we got to Innisville Road where the 400 was shut down to one lane due to a crash. I have never seen a car with trunk as flattened as the one there.

Caging back along Muskoka Beach Road was nice. Fall colours were OK but need a few more days. The road is a bit rustic but OK. A fall colour run on a bike is a double edged sword. Nice colour and slippery leaves on the ground.
 
Last Sunday eastbound 401 off ramp to hwy6 South. About 4 cars back from my right turn and a Corolla comes straight at me headed for wrong way on the 401. Waving at the 80 year old to stop, the Dodge Ram behind me swerved in front of him, got out and helped him make a 5 point u turn. Traffic was doing the normal 120. He would have died.
On the way back from Hamilton later following a Bolt, ricer civic does a quick left turn onto 6 north in front of the Bolt. Big swerve on two wheels for a second.
Get me home ffs!
