Nope
Canadian Human Rights Act says substance dependence, alcoholism or drug addiction, is a disability and must be accommodated

You forgot the "....to the point of undue hardship"

I said...

"It's not that simple... when there's injuries and/or damage involved."

"It's one thing if an employee is just drinking, or being drunk at work... that alone won't give cause.. but it's much different scenario if that person injures themselves or another, causes damage.. or is a threat to others.. with their actions."

The link you posted supports everything I said.

Court rulings confirm everything I said...
Dziecielski v. Lighting Dimensions Inc (for example)

Again.. The PSA and unions are protecting these guys.. not the courts or charters.

So all those contracts i signed where i agreed to be sober at work aren't worth the paper I signed on? Damn! So many missed opportunities..

😁

A lot of employment contracts are unenforceable due to the same mistake a lot of companies make when having people sign them...
having the new employee sign it when they arrive on their first day at the new job... or after.

Some good police work. Looking into the VIN more carefully and realizing it was stolen. Probably one of those guys I've asked myself...how does he afford a car like that? Well, I guess this is how.
Another gun off the streets for good measure.

It shows how much criminals are concerned about the justice system. Already released on an undertaking and he chooses to drive around in a stolen S5. dgaf at all. If he picked a camry, he would probably never get caught. Honestly, after the first criminal conviction substantially changes the path your life can follow, there is little reason not to continue with crime. Profitable, fun, few consequences.

He'll be out on bail and committing more crimes, to pay for his lawyer, in short order.

Preaching to the choir...

I could not find data for 2023 BUT data for recent years shows that there are about 120 cops on paid suspension waiting for court cases in Ontario and 20+ in Toronto alone. The TPS number covers close to half what they claim to need to hire....

It's not just here. In the UK the "Met" has more problems than you can shake a stick at and the same problem as we have in getting rid of the bad apples. The head of the organization wants 70 or more internal affairs types to do the weeding. Multiple legal barriers etc

The level of trust is about 25%.

I was trying to help a friend wrap his head around his tax situation with regards to starting a business.

1) How much cash do you need in your hand, after taxes, to run the house and feed the family?

Then how much do you have to invoice to make that happen? He is married with three kids and he's the only bread winner. I needed his claim code to come up with a gross to net salary.

I think it's code 5 but called the CRA to confirm. They couldn't answer the question, even after involving a supervisor. I was told to talk to my accountant. They wrote the book but can't read it.

Are we getting 30% more of these????
You can't expect the CRA to help "your friend" commit tax fraud. This thread is about police helping themselves commit crimes.

Are you referring to the claim codes on TD1 forms?

Where was there any mention of fraud?

Not related to the question but in reality my friend is a victim of fraud and the police tell him to take it to a civil court and pay lawyers to resolve it instead of the police serving and protecting.

It was a stupid simple question that I wanted clarified. CRA couldn't answer it.

Cause for dismissal in Ontario.

In Dziecielski v. Lighting Dimensions Inc., courts upheld the company's right to dismiss with cause. The decision was upheld by Ontario Appeals court.

You didn't state "fraud" explicitly, but;

1) How much cash do you need in your hand, after taxes, to run the house and feed the family?

Then how much do you have to invoice to make that happen? He is married with three kids and he's the only bread winner. I needed his claim code to come up with a gross to net salary.

Looks a lot like you're asking the CRA for retroactive tax planning advice.

No. Question 1 is common sense. If someone offers you a job at $120 K a year plus benefits and company Mercedes don't think you're going to have $10 K a month for mortgage and groceries. Once I clarified the claims code I could tell him if he needed $XX,XXX in his hand He has to make XX% more to cover what the government expects as their share.

All I wanted was confirmation of the CRA claims code and I would go to the tax tables and advise him of some rough numbers. Does he need to work more than 40 hours a week or raise his rates?

see post #5,722 ;)
If I read it right, the implication is that a disease such as drug dependency or alcoholism has to be tolerated. Unfortunately there seems to be little protection for the potential victims.

I'm not in favour of a return to capital punishment but there doesn't seem to be any accurate way of determining the risk level. Do we execute 5,000 people a year to potentially save 300 innocent victims?

If there was a return to capital punishment would it make it worse with more police chases killing more innocent bystanders?

Wonder if he was cut any breaks? DUI has a 90 day roadside suspension, and impoundment of company vehicle (which costs about $1000) is like a speeding ticket, it's a personal expense of an employee, even in a company vehicle). When one goes to court, 1st timers get another 90 day suspension and 9 mos of interlock.

I wonder if he is issued a police car with an Interlock paid for by the public (about $2K for an interlock)? I wonder if TPS gives him a 'take home' company car so he doesn't get dinged $1000/mo facility insurance rates on his personal vehicle?

They are, to a certain extent. If you are found impaired or your substance abuse (hangovers, missed time) is impacting your job performance your employer needs to accommodate your rehab. That rehab can include a performance agreement that gives the right to terminate you if you relapse.

If you do something that is cause for termination, substance abuse is not necessarily a free pass, you could be fired with cause.

For example, your employee cass in and says I got a DUI last night, I won't be able to drive the delivery van for a while. As an employer you must accommodate that employee till she gets well and back on track. Even if her job is 'driver'. If that employess was driving your company vehicle and got into an accident + DUI, you would have grounds for termination.

Anything can be challenged in court, but it's pretty clear in case law that courts do as noted above.
