I have to say, that's a pretty troubling attempt at by-passing individual rights. I think we are entitled to more privacy and freedom from arbitrary inspection. We'll see if anyone challenges the constitutionality of this.

Actually the law doees require that.. Basically you gotta let cops inspect your house whenever they please.

Read into it and you realize that this bylaw is geared at targeting a specific group, while simultaneously making the town judgment proof by making it a blanket bylaw, rather than specific. The average home owner would have no reason, nor desire, to so fortify his residence.

With the state and direction of our economy, I see more burglaries and home invasions on the horizon. Since Canadians are supposed to call 911 and hope that the criminals don't hurt them TOO badly while waiting for the police, one way to protect yourself is to secure your home. I see measures to protect your entry points becoming a lot more popular in near future.

This is the part that really sticks out to me. Open invitation to go to any house or property in clarington and go on a snooping mission for any reason. Wasn't there a member here getting **** from the municipality somewhere out that way for working on peoples bikes? and now they can just wander in there any time they feel like and snoop around under the guise of this stupid bylaw?

The law certainly looks like it has this exact consequence.. An open invitation for a cop or a bylaw officer to go snooping around your house.

That part is certainly disgusting and shouldn't stand up, if challenged in court.

And who can afford to go up against a determined municipality in court, on an honest dollar?

the cops have had hydro co. employee envy for a long time ,,, as there is some legislation somewhere that a hydro employee can enter your home "any time reasonable" ... so for a while, the pot busts where being done under the guise that the hydro can walk in and see whats going on in there,,then call for help when they notice criminal activity ... grow ops... etc the cops need a warrent, but hydro doesn't .. and I think there are some bylaws already in place with regard to bad hygene,, mold, where a bylaw officer can inspect how clean your house is... intended to stop hoarding..
so this seems to be an extension of that slippery slope,,

I guess , sort of like a game warden does,, if they "think" you are a poacher,, they don't need a warrant. ? I don't know if that is correct, but I know the WRPS uses hydro employees to gain access legally,,

(a) inspecting, testing, installing, repairing, removing or changing, when it is lawful for him to do so, any meters, wiring, piping, fittings or other apparatus of the contractor for the measurement or conveyance of electricity or gas supplied by him, or
(b) ascertaining the quantity or making other measurements of the electricity or gas consumed or supplied,
enter any premises belonging to or occupied by the purchaser to whom the contractor has undertaken to supply the electricity or gas.

“contractor” means any person or body that has undertaken to supply electricity or gas to any purchaser;

so,, if you buy electricity [or gas] then that company can send someone in to look see "at all reasonable times"

The bolder part is important. The other important part is that they can have access to the meter which is on your property but outside of the house.

They can't just barge inside your home against your wishes. Not even cops can do that unless there's good suspicion of criminal activity going on.
 
well,, i was trying to say, there are a lot of people who can "barge" into your home, but they call it ,,inspections, or whatever... and they don't need a warrent..but Cops can't without a warrant.
bylaw.. gas meter, electric meter, game warden, fire marshal ....f&cs ?

also, read section (b) ascertaining the quantity or making other measurements -snip- which they determine must be made inside... snip . enter any premises ,,,blah blah ... which is what they do.

some grow ops bypass the meter,, they can be detected outside .... then the cops get a judge to auth them to enter based on evidence... there may be theft going on , and they need to enter to gather evidence..
some grow ops pay the bill... so there is no theft ... so the cops get frustrated ... so they call the power company and mention a certain address,, that may or may not be a hazard, or a theft, or a diversion, or etc ..the hydro can do as they please at that point,, oh,, as long as "at a reasonable time" ,, and have a tatical squad standing by for a resque.. hey,,, they do it ... I don't agree with it..

Learning from the G-20, the cops on the street can be misinformed by a superior (in rank) officer into believing that they have rights that actually don't exist. Fight it in court after the damage is done? Get real!

How much of your life do you do you want to waste to see someone get a slap on the wrist.

At the moment the cops are getting enough bad publicity with buddy systems etc.

As I read the law you can't have a gate at the end of your driveway with a fence around the perimiter. Or a warning system to let you know when some one pulls into the driveway.

Thieves tend to be opportunistic. If they have to travel more than a couple of Km from home, or one of their hang-outs, then they're unlikely to do it. You're more likely to be robbed by your neighbour's kid, than by some international jewel thief.
