They fought tooth and nail to keep your depo - and then finally, reluctantly returned it after they realized there was no chance of you buying the bike.

If they were the "better ones" as you so put, they could have easily returned your deposit without a fight and not dragged it on over a couple weeks. Hell, they can't even legally keep your full deposit as per OMVIC regulations - look it up.

I don't understand how any self respecting individual could ever consider doing future business with somebody who lied and treated them with such a lack of respect. It's mind boggling.

A good lesson to be learned by everyone regarding signing contracts - especially when the stated bike is different than the one you agreed on!
 
No, prior to this thread I didn't even know about these guys.

It's not just them, these types of interactions happen everyday.

The way I see it, GM didn't HAVE to give back in store credit or any sort of reimbursement and tell me to sod off.

No it didn't, and Yes, they did.

As per OMVIC:

if the dealer agrees to cancel a vehicle purchase agreement, they are entitled to claim "liquidated damages" and retain a part – or all – of your deposit.
Liquidated damages arise from the expenses the dealer might have already incurred in when selling the vehicle to you: e.g.
  • Advertising
  • Freight and administrative costs
  • Cost for the loss of profit resulting from this cancellation
They would have to prove that they incurred costs by you cancelling the deal, and provided a detailed breakdown.

eg: You bought an exact vehicle(same VIN) that was specifically advertised - they could use some/all of your deposit to re-advertise that specific vehicle. They specifically ordered a vehicle for you, they could use some/all of your deposit to cover any ADDITIONAL shipping(NOT freight/PDI costs).

in 90% of the cases, the ACTUAL costs incurred by the buyer cancelling the deal are not worth the hassle of the dealer going through the claim process, and the buyer gets the full refund(read: not store credit).

Anyways, I'm done.

How to do an oil change? Lol. Just busting you but seriously the best advice is to buy the maintenance manual for your new bike and start from there. It costs about what a dealership would charge for one, maybe two oil changes.

1-Not to use Rosie toes for your brand spanking new bike for one. I like him, but I wouldn't bring my bike there for anything. Now if you have anything older than 2000, he is your guy.

OP would have an uphill battle in court with the stated contract being for a different bike. The dealer could very well turn around and produce bike in contract and claim innocence, or produce the bike OP is looking for and again, claim innocence.

While your analysis might work in a fairytale world, OP would have to fight tooth and nail for a penny.

Is the outcome ideal? No. I would be just as upset.

However, in this case... it's a realistic "best case scenario" for the OP. And from the sounds of it, he's pretty happy with the outcome.

Holy tits what a thread. lots of good points on either side of the issue. About half way through I was planning on posting how I wont be going anywhere near Kahuna for their dickery, but I'm glad to read on that they resolved the issue.

Here's my opinion, (if anyone cares for it) There was no possible way for Kahuna to benefit from keeping the money. None. Full Stop. Because if that was the case, I would be posting right now about how I have no intention of ever setting foot in that place. Even though they're about 5 minutes away, and I need to buy a good grand worth of gear for this season. That's a $500 loss on their part already. If even a single other person saw this thread and felt the same way, boom, further loss. No one is going to read this and say "oh, you know, I feel bad for Kahuna, I'm gonna go out of my way to shop with them.

At the end of the day it doesn't really matter who was right, whether the contract was valid, any of that. A business owner should be able to immediately recognize the loss here as a result of negative press and move on, which is what I imagine happened.

but just for dickery sake, next time, don't sign anything until you're ready ya dummy.
 
You should be glad they decided to give you in-store credit. Everybody likes to bash on Kahuna but when they have their door-crasher sales, the same people are quick to line up. Lol

Can you please provide me with the GM's contact info?

I'm also dealing with an ongoing issue at Kahuna that I'd like to contact him about. Discussion for a resolution with my sales guy doesn't seem to be going anywhere.
