In the behaviour seen in the video, I'm with you, this is 100% on the car and that driver should not drive again as they have the wrong attitude (obviously nothing remotely like that will happen). I have no idea if there was a prior interaction that led up to this. Yes, the bike was taking the lane but I'll do that sometimes when close to an intersection to keep people from passing on left and turning right in front of me (which happens very often downtown especially taxis). It's not like he held up the car much, there were only a few car lengths open in front of the bike.

He was a bit wobbly but also seemed to have some sort of carrier on the back that could have been a factor. The driver didn't hit the brakes until the cyclist had rolled to safety.

Driver 100% in the wrong. He owns the car, not the road.

What excuse could the driver offer that would get him off being charged criminally?

"Bikes are bad and menaces on the road." I would be shocked if he got a criminal charge even with the video. Without the video, 0% chance. Hell, without the video, there may not even be an hta charge as car could say bike cut him off.
 
Car 100% at fault but I do not think it was on purpose, just not paying attention.... maybe on the phone, etc.. I think if it was on purpose they would have bolted. Car basically hit them from behind and swerved after impact.

Well first off...we don't know what led to the interaction prior to the video.

Then, the cyclist seems to be wobbling and pulling back in front of the car toward the right to 'block' the car. To me it almost seems like he's weaving right/left to block anyone passing him, but I could be very wrong.

100% the driver is at fault, and unfortunately regardless of the lead up to this interaction...the bike will always lose.
 
Fack. Cancel his license already. 10 am on a tuesday on Hwy 400 and BAC was ~0.4 after he'd had a bit of a nap. Some offences should just be one and done. If driving is truly a privilege, he has lost it and should never get it back. This wasn't a miscalculation. 53 yo male from New Techumseth.

News report says he hit the barrier and continued on. If that's the case, cops should have laid a fail to remain charge as well.

Sharing the road with cyclists​

Bicycles and mopeds travelling at a lower speed than other traffic are expected to ride about one metre from the curb or parked cars, or as close as practical to the right-hand edge of the road when there is no curb. However, they can use any part of the lane if necessary for safety, such as to:

  • Avoid obstacles such as puddles, ice, sand, debris, rutted or grooved pavement, potholes and sewer grates
  • Cross railway or streetcar tracks at a 90° angle
  • Discourage passing where the lane is too narrow to be shared safely

It would be interesting to know if the horn was that car. It seems plausible. That car was hard on the brakes, let go and accelerated just before impact. Sure looks like a premeditated hit. Car seemed annoyed by bike so they took them out to teach them a lesson. Obviously we don't have the whole story (and never will) but it sure looks like horn and brake preceded gas and crash. That would imply that car new cyclist was there and did the opposite of what they are legally required to do.
