Ok.. I guess I phrased that wrong. There's a few charges in the HTA that can get you jail time on CONVICTION... that's not what Mr. Greyghost is after, he want's anyone that is charged with drive while disqualified to face a reverse onus bail hearing. That ain't gonna happen.
I'd be happy with either. Right now we functionally can drive (or do almost anything else) with impunity. The first criminal charge changes your life, the rest are almost immaterial. Reverse onus bail for driving while suspended/prohibited seems very justified. Hell, conduct a quick pre-trial where the dashcam/bodycam video is shown along the the paperwork that they weren't allowed to be driving. Then leave them in jail until trial. They obviously dgaf about conditions and will not follow them so releasing with conditions is basically condoning the behaviour.

Sounds like a crap situation all around. Call police for a help with a family dispute. Two 19 yo twins end up shot (one dead, one in really bad shape). Four cops fired so odds are good the twins did something epically dumb. Rich gated neighbourhood with pools and tennis courts (not that this matters, just interesting).

There isn't enough room in our jails for all the murderers, child pornographers, gun smugglers, armed robbers, human traffickers and thieves... Bad drivers in jail? Lol
 
Police 101. Now they have charged the victim. Drop your complaint or you're getting a record for not Respecting Ma Authority (even though we were plain clothes and you backed away as soon as we identified ourselves).

He'll go up against the Toronto legal team possibly one of the largest legal firms in Canada. Possibly BLG. Their job is to make the guys life hell at any cost. The city doesn't want any precidents. A NDA may be part of the settlement to protect the management. It'll take years and. ton of money to fight. The judges work for the government.

Undercover cops.. badges hidden under shirts.. guy starts backing away when shown a badge... and the shove.
The video doesn't look good.. for the cops or the prosecutor.
If they pursue the criminal charges against he guy.. I think it'll blow back on them... again.

When public sourced funds are spent, NDA's should be illegal. If we saw how much money was spent hiding transgressions, maybe higher ups would do something about the transgressions as the heat would land on the brass.
 
And will the cops face substantive discipline for subverting the law and getting reamed on the record by a judge? Of course not. Better luck next time. Today's training course is "Smelling weed is a path to searching anybody legally".

IMO in civil cases a NDA can be acceptable as it could involve corporate plans, trade secrets etc. NDAs should be illegal in criminal cases as they pervert the course of justice.

I was talking about this impending civil case where the cop assaulted a civilian and there will be a big cheque and nda. No trade secrets just public funds being used to protect a goon.

I could see them being part of a deal to drop the bogus charges. They've already committed to extortion, they don't want to waste their efforts or even worse have it come back to bite them in the Civil trial.

Oh yes they are. Keep an eye on the Frank Stronach case, there's going to heaps of "non disclosure", all in the name of "company secrets"... do we really think Stronach was sharing state secrets while (allegedly) sexually abusing his corporate underlings?

i don't agree with ANY sort of NDA, particularity in criminal cases... going to court is SUPPOSED to be you in public airing your dirty laundry... THAT"S WHY YOU'RE IN COURT.
If you go to court and get found innocent BUT you still look like you're a shitheels... it's because you're a shitheel... STOP being a shitheel if you don't want us to find out you're a shitheel.
Court is supposed to be public... that's the whole point of court, it's public judgement... and how can we judge if you're a shitheel if all the testimony is secret.

No, they're not.
NDAs are not enforceable when reporting crimes.. and/or providing evidence in a court if the info is relevant to the court proceeding.

It may just be terminology confusion. I fully expect the judge will drop a cloak over stronachs trial. If someone wants to sit in court, they can learn what goes on but anyone making that information public will get a judicial beat down.
