Pretty much what I was thinking. Rape is a very specific concept, under the law. There are miles you can go between consensual sex and rape without committing actual rape, while still committing an illegal act (from simple assault to sexual assault).


The offence of "rape" does not exist in Canada, just so you guys know. "Rape" is an American criminal offence, and involves questions related to penetration.

The Canadian Criminal Code does not make such distinction. Whether there is penetration or not, in Canada, it is sexual assault.

example 2- 2 adults having sex 1 slaps the others ***. assault or sexual assault.

example 3- guy hits other guys *** in team sport. assault or sexual assault.

If sporting wood every assault going forward would be sexual assault. If assault does not produce wood then it's just regular good old fashioned assault. Hope that helps.

Assault is touching without the consent of the complainant. Sexual assault, in contrast, deals with actions that are sexual in nature as to violate the sexual integrity of the victim.

The test to determine whether the conduct is sexual in nature involves considering:
  • context
  • part of the body touched
  • nature of contact
  • situation in which it occurred
  • the intent or purpose of the person committing the act
  • motive of the accused and whether the accused's actions was for sexual gratification

So, considering the above, I'll leave it in your good judgment to argue whether or not your examples would meet the definition of sexual assault. Keep in mind, too, that the criteria set out above is not from your perspective, but from the perspective of a reasonable observer.

Great post and for those wondering the legal definition of consent:

Consent means the voluntary agreement of the complainant to engage in the sexual activity in question.
No consent is obtained when:

  • The agreement is expressed by the words or conduct of another person other than the victim (complainant)
  • The complainant is incapable of consenting to the activity
  • The accused (by abusing a position of trust, power or authority) induces the complainant to engage in the act
  • The complainant expresses by words or conduct a lack of agreement to engage in the act or
  • The complainant, having consented to engage in the sexual activity, expresses (by words or conduct) a lack of agreement to continue to engage in the activity
 
Maybe we need the Gov't to supply forms for sexual consent that need to be filled out and authorized
by a 3rd party before anything illegal takes place.

maybe one of you smart computer people could make an App for quick hookups. the app would supply everything needed for a good legal ****.

this will help in areas where someone might have changed their mind after.
