He is lucky they didn't give him 100 percent of the blame. Last time someone I knew was on a collision like that they were told it will always be the left turner 100 percent no mater what the other person was doing.

Once you pass 25%, as long as you have insurance, I dont think it matters to you whether you get assigned 26% or 100%. If the lawsuits exceed available insurance coverage, percentages may matter. Over 25%, insurance will ding you with at fault.

Under rule 15.3, it's 50/50 if they can't determine who failed to yield ROW.

No mention in the FDR of an exception if A was ignoring traffic lights/signs. Left turner is always 100%.

Thats a bit strange. If a left turner has a green arrow and a guy goes straight through a red light, it can't possibly be considered the left turners fault can it?

In a perfect world, I agree. It was probably written that way mostly to ease determination. Not that long ago there wasn't much video and witnesses all see things differently. I suspect almost every crash would have ended as 50/50 as at least one person would say the straight car had the green (probably most often the driver of the straight car but also random witnesses are fallible when you are talking about timing down to the second).

The left turning car has a duty to check for oncoming traffic (even those ignoring the light) and is in a safe space where they can wait until they have a safe exit from the intersection. The oncoming car has next to no viable options to avoid the left-turner (which is why this hurts so many bikers). They can change path slightly but they don't have a lot of room to go left or right and not much time to brake to reduce energy in the crash. The left turner has all the power in this case so they get all the responsibility.

Now, if there was some clean evidence (red light camera or similar) to show the car ran the red, could you get a different fault determination answer? I suspect no but I would sure as hell try (pictures clearly show running red, speed was well above posted speed so I couldn't reasonably have seen them as they were too far back when I checked, etc). I suspect the cops wouldn't be all that helpful and am sure that the insurance companies wouldn't be.
 
OPP patrols 6N. I was following a guy on Conc. 11 approaching 6N using both sides of the road and both shoulders. Called *OPP. That's not our jurisdiction. 11 ends at 6N. He’ll be on “your” road in 60 seconds. Call us back when he is. SMH.

An old girlfriend had exactly that happen to her. She was stuck in the intersection until the light turned red then completed her left turn before the light on the cross street went green. Or rather almost did. It was an intersection of two 4 lane roads and when she was even with the oncoming right lane, a car blew through the cold red and broadsided her. She was charged for failure to yield. Convicted, too.

A few years ago it was a "common" technique used by insurance scammers with a twist. Stop at the red and then go when the left turner moves and crash into them. Then the pile of people in the car start holding their necks and of course "go" to their buddies physio clinics....

Same idea as that Ragu.... guy (remember him) backing into people on the 401.... a decade or so ago.

I live in Brampton, remember? I doubt there's a scam that I haven't heard of ;)
 
If that was on the ticket, I would be shocked if it was considered a fatal flaw. I suspect jp would allow an amendment. You have a better chance if they flubbed your license plate or wrote down something completely wrong.

The MTO turned down my request for a personalized plate.

Driver of a dodge ram called the cops after he crashed into a tractor. I dont think this interaction is going to go the way he expects. No injuries. Bleeping rams.
 
A few from tonight.

Driver of 2019 land rover calls police because they hit a deer in melancthon and their vehicle is undriveable. No problem so far, that happens. Unfortunately for the driver they expanded on their story and said the deer was lying dead in the road when they hit it. Oof. That will be an expensive lesson (at-fault collision supported by a police report that confirms 100% at-fault). I'm not sure why they called the police or what they expected to happen.

Driving up the 400 near barrie well after dark are three ricer subarus. Rear car has four white lights and no red lights as tail lights. Middle car has no tail lights but when they hit the brakes they get two red and two white lights on the rear. Front car has lights but is stanced and wobbling around when they hit bumps. Obviously loud exhaust across the board. All three should have their plates pulled. Morons.

Another dumbass dump truck driver hit an overpass with his raised box this morning. 401 @ Mavis. Assessing damage to the overpass now.
