I'm in the same boat with the 10 over ticket. Caught at 69 in a 50 reduced to 60 in a 50 (I actually thought it was 40 here so I guess I was lucky in that respect). First ticket on my bike. Speed trap on Scarlet southbound yesterday afternoon. Not sure if I should bother fighting it, though, since I doubt it will get dropped completely and it's already a minor offense so nothing much lower they could lower it to. Don't care about the fine, just the insurance. I'd pay 10x the fine to not have insurance hiked.

Might have noticed the trap if that road wasn't so crap. I was busy looking for potholes to avoid.

Sucks! ya skip the prosecutor meeting and either plead guilty or make a court date. They will not reduce it since it already has been. Insurance shouldn't be hiked right away, usually around renewal time but not always. Some ins companies let one slide here and there!

State Farm goes back 5 years when looking into HTA convictions!

Why is everyone so concerned about the points? Insurance doesn'tcare about the points and they ddon't affect anything unless you're a REALLY bad driver and have a whole pile of them...

But what is my defense going to be, anyway? The ticket says I need to plead not guilty... Otherwise I was going to show up and just hope the cop didn't show up and then just plead guilty right away if he did...

I'm tempted to try the charity offer with the prosecutor, too. Sounds unlikely to work, though.

Exactly, that's why I was asking him, to make sure that's not why he offered to pay more.

I offered to pay more to get the ticket dropped, this worked once before. and ya points only matter to the MTO, get enough of them and they will ask you to come in and explain why your so dumb.

Can anyone else chime into this technique of not receiving the disclosure in time/no time to review etc.?

Can't they just argue that the defendant had ample time to pick it up before hand and neglected to do so?

If the disclosure was made available within a reasonable amount of time for it to be obtained by the accused, then failure to do so falls to the defendant. If, for example, the disclosure is provided at time of trial and not before, then the issue is caused by The Crown. Providing it only a few days before trial would also be The Crown's issue.

You can't just let the disclosure sit on someone's desk for weeks, then blame them.

Thanks Rob. This is what I don't understand. People are saying that they didn't bother to pick up the disclosure for months and then seemed to get away with it and reschedule.

Well they might be able to reschedule, but all that does is give them another chance for the officer to not show up. Any delay incurred from that sort of thing is construed against the defendant, as his failure to obtain disclosure is the cause, and so such a delay does not count toward 11b submission.
 
bump my court date is tomorrow but i made a new thread. i requested typed disclosure last week, and have yet to receive anything. tomorrow i will be going in hoping a.) the cop doesnt show, b.) ask for adjournment.
