Popping wheelies at walmart after business hours.

my point exactly, if your neighbours file a complaint, you be subject to the laws in your area..

the question earlier in the thread was "what if i have 10 acres of property" if your in a rural area, and have that much land, chances are you can find somewhere to play without bothering anyone.. but yes, if its a nuisance and someone complains, the law is the law.

10 acres is pretty small if you plan on building a motocross track.

Even if you had 100 acres a group of piped 450cc MX bikes would make a lot of noise and could easily still bug your neighbours.

Well then I guess the little stunt shows they did at envy cycle were done illegally............ I guess.

But they exist and ARE used, by various car and motorcycle clubs.

As to "winning the lotto" you could take home an entire $35M Lotto Max prize, and still go broke by building a track within the GTA. That's if you could get the noise and zoning variances, in the first place. There's a reason why tracks are generally an hour+ outside of the GTA.

Yeah I know I was just kidding about the lotto deal, I know it would be expensive as heck to build a track. In that scenario I'd rather rent an entire track for a few days and hold a draw for GTAM members for free use of the track (no entry fee).

As far as the zoning is concerned, consider the fact that Pearson airport already has a great deal of noise around it so having a track nearby with specific operating hours wouldn't be a big deal in my mind. Or even Downsview, it was a former military base, people accepted the associated noise for a long time.

Pearson and Downsview are both grandfathered before the NIMBY crowd came to prevalence.

Pearson also Generates Billions of dollars for the local economy.

Downsview is a Canadian Government facility.

There is no possible way ANY type of racing facility could ever be built in the city limits of the GTA.

Look at the Fort Erie/Canadian Motor facility in Fort Erie, or TMP for that matter.

The TMP road course was shut down for 5+ years for zoning/noise reasons and its in the middle of no where

Canadian Motor speedway was to be built on worthless land, in a town that has ZERO industry and draw for anyone but existing residents and it still gets shot down.

The racing/motorsports world in Canada has no where near the critical mass to build facilities like this in Urban areas, believing otherwise is foolish at best.

Did you not see barriers at the ENVY shows? Restrticted public access on your own property is different the doing wheelies in a Walmart parking lot...Even if you cone off a section, its not your property...However yes Im sure the police could have shut down the ENVY shows for some reason if they really wanted too....I guess theres a little bit of a difference between and organized event on your own property and just going to Wallmart to practice your wheelies...

You misunderstood. I'm not saying its going to snow in hell, I am saying it would be nice if it did.

Statements like that make it look like you actually believe it would be possible.

I was just pointing out that your thought process on the zoning and noise was flawed.

Well hold on now. If one thing was said in this thread its that even if you are on private property its a criminal act. I never signed a waiver stating that I understand that I may be at risk if injury when I went, and do you really think that fence would stop an out of Control bike from being dangerous? Either thr shows were illegal it people here are pulling laws out of their ass. You can't have it both ways. Either it IS or it IS NOT legal to stunt in your private property. Which is it?

*edit*
Sorry but I wasn't talking about mall parking lots. I was referring to personal private property.

Or, for that matter, look at how Calabogie was receiving complaints about noise when they held a BICYCLE RACE

you've obviously never farted in cycling trunks.

Gets pretty loud.

Nobody wants to see me in cycling trunks. Seriously.

I just wish that when people pulled crap like that, looking at a schedule and calling in a complaint just to be a pain in the butt, the authorities would come down on them HARD for the false report.

Actually my thoughts on the zoning are not flawed. You could mix in the track noise with the airport noise and I doubt anyone would really notice. But as you mentioned the revenue would be small in comparison to that of a large airport. The by-laws could be modified or a special permit could be issued. I don't think it's a matter of whether it is possible, its just that not very many people give a ****.

It is paradoxical, but cops do not have to know the law they are supposed to enforce, let alone having to obey it. They can charge you with pretty much anything and anywhere. They have the power to make your life miserable even if you are a model citizen, so keep calm and respectful no matter what they throw at you. Even if you are 100% right it can cost you a lot of time/money to fight bogus tickets they can issue with almost total impunity. Ride safe.

Your comparing apples to oranges.
Your home propertly is zoned differently then an industrial building that is zoned for a mechanic shop....They are alound to rev bikes all day, you in most cases are not alound to make excessive noise at your house...
Laws are laws but police have descresion and can bend or ingnore them

There was an event in Oakville, the organizer had permits....We rode Sat, but the event was shut down Sunday because of an Oakville specific by law that was overlooked...No noise on Sundays in Oakville...It was leagal on Sat but not on Sunday...

I don't think many homes have private parking lots. I was referring to private lot to lets say my shop. If I'm doing a w wheelie in my parking lot and a cop is coming down the road as sees it I'm gonna get charged? Yet people can gather her in a much smaller lot to watch bikes stunt and it'd br OK? Like I said. Can't have it both ways. It is or it is not.

gray area! Cop can charge you, weather it will hold in court is another story...But like I said, if they charge you with DD you loose either way right off the bat....

I have my own 14,000 sq foot shop in Mississauga, with the same amount of parking lot space in the back...Ive had cops tell me I can be charged for doing wheelies back there, but I never actually have and still do every so often...

If they do charge you, they would most likely play the no restricted access card, if you dont have it gated off from the public road....

No matter how wrong a cop is, if the wants to write you a summons to court, there really isnt anything you can do about other then take it and go to court.

Cops are wrong sometimes too, I had a cop tell me he was towing my bike because I was riding at night with a G1/ M2...Apparently he thought an G1/M2 had the restrictions of just a G1 or M1 and I was not supposed to be riding at night...He was totally wrong, I knew that, but what could I do besides take the ticket and have it tossed out in court....I was lucky becasue another officer pulled up, and he confrimed I was right and he was wrong....Had he not, my bike would have been towed ...That is my point! Cops CAN charge you with whatever they want....What happens with the charge is another topic....

And at the end of it all we get to what I was gonna get to..... MONEY GRAB. I have such a hard time with the statement that cops don't have to know the law their charging you with. I swear I don't know how many times I wanted to just rage when I hear that. That's your job, to uphold and enforce the law. If you don't know it to the T then how can you enforce it. I had the same argument with my father's cousin who's a cop, who also had the most ******* attitude the whole time.

Yes it sucks, but what can you do other then try to aviod these situations all together. Just think about my example....I know I was 100% about the G1/M2 situation, and yet I was still stuck arguing with a cop who doesnt know the laws hes trying enforcing....You either sign the summons willingly or you get arrested. I just kept saying "your wrong, go read your little book, your wrong"....Then the other cop saved me....sigh...I never rode my bike up that street ever again after that, its filled with police. Thats how I tried to avoid that situation again

Hey I understand you 100%. However, the longer we the public do that the more power they will try to dominate us with. Hell I can't even do a wheelie in my shops private parking lot.
