In the US, it appears that cops are up against a new brand of citizens that know their rights and are using them. Watch the body language of these cops, they appear to be scared of this guy for doing just that:

Wonder how this would play out here? Does the Canadian Charter of Rights and Freedoms allow Canadians the same rights as our US counterparts?

Police stops in Canada should have bacon and poutine for all the inconvenienced drivers.

Give it ago..let us know how it works out. But just for the record these FREEMAN on the land tactics are not at sucesfull as the internet videos would have you belive. Anyway the longest i spent at a DUI checkpoint was like 3 mins cause the guy in front had an issue with his trailer. That the cops gave him a warning about. Seems quick just to answer no and they just wave you through.

It would be best to know some of the laws as well, but knowing certain sections of the charter are useful too. However, our charter is subject to s. 1 which means some of the rights could be reasonably limited (assuming you have a cop that knows what he's talking about which is rather difficult to come by) this is something Americans don't necessarily have - so this is how the constitutions differ. Also its always good to film your police encounter with your phone because it is NOT illegal as they are public servants.

In this country thats true. In some states there are laws against it.

Here is the skinny from the Canadians Civil Liberties assoc. Police do have the right to stop you when driving to check for DUI, Mechanical safety and papers. I would not suggest trying these talking points at a DUI checkpoint in Canada you will probably end up with an obstruction charge or ’refusal to blow’.

They're not scared. A little taken back by the guy, but I wouldn't say they're scared. He only refused to answer questions... but notice he did everything they demanded of him.... they could have demanded a breathalyzer and I certain he would have complied. They got in close enough to smell his breath...
 
I don't get what the issue is here. The COPS are looking for drunk drivers. We all complain about drunk drivers on the road, and when the COPs are actually doing something positive everyone wants to give them are hard time. Just say no and move on. Stop wasting everyones time...

Its a Freeman thing. They seem to think that DUI checkpoints are illegal. Although the supreme court has ruled they are not as long as they are done properly. But the states is a terrible hodge podge of states and federal laws so who knows
 
No they aren't, they look for drug smugglers at these checkpoints/illegal immigrants. One of the first questions they ask you is whether or not you are an American citizen. Next to no one gets shitface wasted in the afternoon. Again, this isn't for drunk.driving. far from it.

Your confusing the video posted and the topic with another series of vides. The immigration checkpoints are a whole other mater. whats being discussed here is DUI checkpoints And plenty of people get drunk in the afternoon

Where in the OP does it mention drunk driving? Nowhere. If you knew a thing about these checkpoints you'd know that they are NOT for drunk driving -- why would I even make up such a rash statement? They are to check citizenship status and to catch drug smugglers. They hide behind the idea of a DUI checkpoint to make it constitutionally valid. Look at the location, its in the middle of nowhere, look at the time of day. Be a little bit more critical for Christ's sake stop taking things at face value it gets you nowhere in this world.

First thing offices asks after telling him to lift his visors is "Have you had anything to drink today"

You can read into the intent of the checkpoint all you want but its presented as a DUI checkpoint by the video poster. The question posted by OP was how can refusal work a these stops in Canada. That has been answered.

Well thats line of questioning does not really relate to my point at all and the answer is dependant on how much storage one has available.
 
Oh but it does, if they don't try and get you for smuggling drugs in a large vehicle, they're going to try and ping you for something. This isn't conspiracy, its been done plenty of times before. I've seen many police wave motorcyclists through DUI checkpoints in Canada because they know for the most part that if they were drunk they wouldn't be able o balance let alone operate the thing ( in MOST cases, not all). I'm not someone who believes checkpoints should be outlawed but when they are implicitly corrupt then there is a problem.

Also, a checkpoint to a motorcyclist is MUCH different than a checkpoint to say, a Latino or black person. If you think everyone views checkpoints as a way to "serve and protect" you're wrong. So just because the title says "DUI checkpoint" doesn't mean jack. That only gives you one perspective out of the whole subject of checkpoints. Try and think from another perspective and you'll realize its not all daisies and roses.

Your point is a mess.
I have been checked at a DUI checkpoint on my bike. Bikers do drive drunk. Yes i have also been waved through at a checkpoint but they have every right to ask you if you have been drinking. The point that the checkpoints also nab people for other crimes is not a point at all. You make it seems that they try and get everyone for drug smuggling at DUI checkpoints if they are in a car.
