There is no flip-flopping. That mount violates a different portion of the plate laws as previously stated.

You could conceivably argue, IN COURT mind you, that it's necessary for the plate mount to be hinged as a means of moving it for tire removal, etc.. You would of course then be asked by The Crown or JP why you felt that it shouldn't have some sort of retention system so that the mounting didn't create additional visibility or safety issues, but whatever. That issue hasn't gone away. In this case they wouldn't even bother to argue that point, however, because there's lower hanging fruit that they can make you deal with first. You could sputter on to the JP about how the hinge doesn't effect blah blah blah and he would just say, "View obstructed. Guilty."

Perhaps I'm mistaken, but when I picture a flip plate I am imagining a plate that its mounted just ahead of the tail light that's on a hinge of some sort that makes it easy for the rider to move the plate so it sits flat against the undertail and is completely hidden.
Is my interpretation incorrect?
Further, mounting the plate just aft of the shock is illegal because the view of the plate is at least partially obstructed by the tire, passenger pegs and the tail of the bike.

I'ts pointless to argue about this. There are those that want the plate mount and there's no reason other than illegal activity. Justifying it's legality or not isn't really important...
