A lot of older models do not have any indication on the dash that the ECU has been flashed or replaced. A replacement ECU would be visually different. Mine was a red chip (naturally).

Then you have to eyeball the headers or go in there with a measuring tape to see if they are different diameter than stock to see if it's a full system or just a pipe replacement.

These will say m796 DP if the ECU has been upgraded.

The end can on the 1200/1260 Multistrada’s is simply a can with nothing inside (no baffles or sound absorption). Sure you can put a $1,000 Termi on it but there’s no ecu flash needed obviously because it’s an expensive empty can.
All the sound absorption is done by the cat. Delete the cat and then there’s ecu tweaking recommended. I’ll reckon it’s not the only model this way.

Exactly. If you remove the cat, a tune is recommended but not necessary. The Scrambler 800 Icon I just traded in had the cat deleted (along with the stock end can) with a Comp Werkes exhaust in it's place with no tune on it and it ran fine.
 
This one's still on the market. I'd rather take this one at $8,000 (or less) than that older 796 at $6,000 that has more than twice the mileage and needs a $800+ desmo service. In the end you're on a newer/updated, less mileage bike for similar money.

The black one looks cool but seems to be missing anyway to legally mount a plate and I don't hold out much hope for passing a sound level test with that small can (and areas running them are expanding quickly).

I contacted the seller. He said it includes all the stock parts and doesn't need anything to pass a safety.
 
I still like this one...but the few cosmetic issues (peeling stickers, lack of sticker on front fender) makes me feel it was hit.

I had the same experience with my 2015 821 Hyperstrada. The "slip-off" portion of the exhaust was a muffler with cat integrated into the elbow. It came with a Competition Werkes slip-on that ran fine without a tune, and no differently compared to when I reinstalled the OEM slip-off to avoid disturbing the neighbors when returning late at night or leaving early in the morning.
 
You sure you need/want over 100 horsepower?
 
Upper 2-digits/lower 3-digits is the sweet spot for the street for sure. 80-110 I'd say with some TQ.
