write off!

So before you get to in depth into this have you verified thats your bike other then visual?
Compared VIN's?
As that bike has a different seat then yours and thats from what I can see in your 1 pic that shows hardly any of the bike?

I wouldn't jump to conclusions without verifying first ;)

Are you the one thats been buying all the bikes I wanted in the last couple weeks? lol its been someone from Hamilton..

LOL no . I take a glance at the impact lists from time to time but it's not something I get involved with. I work for a leasing company in Woodbridge.

I thought anytime a car or bike was deemed unrepairable by an insurance company it automatically received a salvage title?? Insurance companies clearly have something to gain from not giving a vehicle a salvage title, future customers don't.

Motorcycles don't get Salvage titles, They get either Clean or Irrepairable.

"Motorcycles are included under the "Irreparable" category where there is frame damage requiring replacement."

A claims adjuster may tell a claimant the bike is "written off" but, that doesn't mean it's irrepairable. It maybe simply too expensive for the insurance company to fix. So the cleanest and cheapest way to handle is to write a check and call it a day. It's possible the bike was branded but, the shop used a different frame as well.

Save yourself the aggravation and check the vin # first, proceed from their.

If the insurance company wont repair the bike, its probably a pricey fix. You a fixit yourself type, like beyond cosmetic repair plastics. Nitty gritty innards type? Probably the only way you could save money doing it yourself rather then replacing the bike on a bike written off by insurance.

Again, check the vin #, you could be saving yourself some serious headaches.

the seat i have for sale on kijiji,,that seat is a luimoto i took it off and put stock back on..its my bike..unless someone went to the trouble to put only one green brake line on th rear and duplicate the wheels and stickers including the kwasaki racing sticker under the name in silver which is highly unlikely.. i painted those wheels myself and installed the pipe and the ninja oil cap any more description i need to give?

But if it was a head on collision and laying on its right side, Wouldn't the front wheel be ruined, The exhaust sratched, fairings that the sticker was on destroyed? How fast were you going because a head-on collision will destroy a bike?
Also I can't see a ninja oil cap or the sticker you are talking about?

But the chances its yours if the VIN's are the same = 100%
The chance that someone has some of the same common mods as you, likely?

Just call and say can you read me the VIN because it looks like my old bike and if it is I might want to buy it, I'm sure they would give it to you or at least enough of it to check.

But without the VIN you cant know 100%

It's obviously your bike, forget about trying to convince everybody.

Just to try to figure out how much damage and how much to repair.
How fast were both vehicles going in the head-on collision?

Check the VIN and get back to us. I have a strong feeling they bought your bike and parted it out and put it on another bike that's missing a few parts and selling it.

Thats exactly what I was thinking because minus Batman's bike there aren't many bikes that can be/or worth being fixed after a head-on collision.

Bambam,

It was likely too expensive for the insurance company to pay for the repairs. Doesn't mean the bike was irrepairable. They were likely quoted the cost of repair and decided to just cut a check. Once you accept the check, the bike is considered the insurance company's and it's up to them what to do with it. The shop probably purchased the bike for peanuts and performed the repairs at cost (instead of market cost) That's up to the shop to decide if it's worth the risk to pour money into the repairs and sell it to make a few bucks.

It's likely only a matter of cost to repair or replace. And they take the cheapest route every time. Doesn't mean the bike was a salvage title bike. If you insisted upon having the bike returned, they may have cut a check for a much less amount to cover the repairs. You still would have been out of pocket.

+1 - this is exactly what happened to a buddys '07 R1 last year. He got hit by a taxi (slow speed collision and taxi was 100% at fault). Not salvage, but the cost of new plastics and other parts like a tank (got scratched and a minor dent) etc. made it uneconomical to repair so he settled for the cheque and bought the bike back from the insurance co. I have no idea how he aranged that. With money left over, he got the bike repaired to almost new and still had $$ left over which he put toward a new gas range - lol.....and he got his helmet and jacket replaced blah blah blah. bambam got screwed being told it was salvage and now back on the road, at least based on my buddy's expereince. In a wierd way, the crash paid off well.

Insurance companies lie! It's a fact.

In Ontario, they are allowed to do anything they want, law is written to their liking, and as an individual, you (or I) have no chance of winning any dispute with insurance company, ever.
Sorry, it's sad but true...

i guess there arent namy of you out there that love your bikes that much.. i loved this bike and being the bike it was if it was repairable..i wanted it end of story! now i see it has been repaired! i never had the option they took the bike before i could even get my personal belongings..

i feel your pain, dude. pretty much same thing happened to me (the way insurance tried to play me).

they kept telling me that my bike wasn't worth repairing, and that i should just let them take the bike and they'll write me a cheque. Problem was, what they were offering was peanuts. i fought with them for 2 1/2 months to get a fair settlement.

it was crazy, and infuriating. but i kept my bike, and she'll be back on the road again, as good as ever :)

This may be true.

But I still blame the OP for taking everything at their word and not exercising due diligence.

If I understood correctly, everything moved quickly, and the deal was done.

You need to talk to a lawyer. Your insurance company outright lied to you that the bike was a write-off. This add is proof that it's not, or it would have a salvage title. Print this add out before it disappears. And like someone mentioned here, pretend you're a buyer, say nothing of what happened. Ask this seller for the VIN. Go to the MTO and buy the UVIP for $20 Your case against this insurance company is based on their dishonesty. If you lie to an insurance company, you'll never get insurance again. But it's ok for them to lie to you? Get these two documents and talk to a lawyer!

Note: If you want to piss off these dishonest bastards who are likely working in collusion with the shop that deemed it a write-off, copy the Kijiji add, write "This was my bike, and it was written off by _______ Insurance company who proceeded to rip me off. Do not buy this bike as it was head-on into a moving car!" Post the pics of the smashed version of your bike. And trail this add with the exact same search criteria I.e Kawasaki, Ninja, ZX10... Also,'watch and do the same in the Auto Trader. Then, once the bastards figure out your relentlessness, offer them $5000 for it and you might get it for $6000 if you're tenacious enough. Call it a form of "street justice." :)
