write off!

Do you have any written correspondence with the insurance company where they tell you that they are refusing to sell you the bike back? Take that...plus the ad...and perhaps find an insurance ombudsman and also mention it to your insurance agency?
 
I'd verify the VIN on the advertized bike (both frame and engine). Does it match what you have for that bike? You could then drop the $20 and get the UVIP for it to verify the branding. Then proceed from there. If VIN's match what you had, and branding still shows okay, I'd make a call to the insurance company to find out what the f*ck is going on.
 
I just check the auction sites and there aren't any really good examples but bikes that are broken in half can get a clean title while bikes with only a scratch get an irreparable title. I think its up to the insurance company that decides the brand put on it.

The seller told you it was in an accident he hasn't done anything wrong (his ad isn't quite up to standards but thats different) I don't know why you want to call omvic and cause this guy problems, he didn't do anything but buy a bike from an auction.

There is absolutely nothing you can do at this point. Maybe in the future if you have to make a claim with your insurance company make sure your happy before you settle.

I think the reason the OP is ****** is because he was specifically told he couldn't buy the bike back (under any circumstances??). Obviously someone did buy the bike (if it is the same one). I'd be a little ****** too taking the insurance company at their word and then later finding out that something is amiss.

Wouldn't the bike being sold come with a salvage title though now?

my issue is with the bike having a head on collision...being told that my bike is non repairable while i was on the couch..not seeing it.. and then seeing it for sale. Omvic should be made aware of the fact this bike had front end damage! It hit a car boys and girls.. moving! If it was repairable..should i not of had that option to repair it?
 
Why not just buy the bike back from the guy that's selling it? As long as the paperwork's good, it should work out, and you should have a few extra bucks in pocket.

Just cause it was wrote off doesn't mean it was given a salvage title. Check the post by AC above showing a couple bikes at an insurance auction, one is salvage one isn't I believe.

Everything written off is eventually sold at auction regardless of what the original owner wanted. He settled, now the insurance owns it and wants to recoup some money. I think there are a couple of insurance companies that do not want the liability of selling the bike back to there original customer. I am not sure of that but if that is the case no one has done anything wrong.

I don't understand why he wants to cause heat for the dealer now? The dealer said it has been in an accident, he is playing by the rules.

OMVIC only applies to dealers. The ad photo looks like someones garage (i.e. a private sale).
 
well to be fair the dealer said, "it was laid down." i think if i was buying a used bike i'd want to know whether it was simply laid down or hit a car at speed

first of all... lets not get this twisted.. my heat? as you describe is not aimed towards the dealer.. I am also a dealer..fyi.. my heat is aimed towards the insurance! If i had an opportunity to fix my bike ? i would of kept it! Too see it after being told it was sold as salvage is wrong! .. I guess you are missing my point

Insurance companies lie, like in this case they did to you. Private sellers and dealers alike also lie. Pretty much majority of the people walking this planet are liars and would **** you over for a couple of bucks. Welcome to life, the sooner you are at peace with this fact the happier you will be

The dealer is responsible to tell a customer if the vehicle was involved in a collision over $3000, structural repairs or alterations, or declared a total loss. Now I am guessing BamBam just called the guy and asked a quick few questions. At this point he hasn't lied (the dealer didn't crash the bike so he doesn't know specifics) a problem that would warrant involving omvic is if they came to a deal and those disclosures weren't made. The Point is right now the dealer hasn't done anything wrong so why call omvic.

Okay then what is the Ontario Motor Vehicle Industry Council going to do to the insurance company? Why even bother mentioning the dealer or the ad then, all write offs get sold.

Omvic is out there specifically to make people honest ... This bike was not laid down like i was told.. it was smoked by a car. I was told by the insurance 10000 in repairs not 700$
