The seller told you it was in an accident he hasn't done anything wrong (his ad isn't quite up to standards but thats different) I don't know why you want to call omvic and cause this guy problems, he didn't do anything but buy a bike from an auction.
There is absolutely nothing you can do at this point. Maybe in the future if you have to make a claim with your insurance company make sure your happy before you settle.

I think the reason the OP is ****** is because he was specifically told he couldn't buy the bike back (under any circumstances??). Obviously someone did buy the bike (if it is the same one). I'd be a little ****** too taking the insurance company at their word and then later finding out that something is amiss.
Wouldn't the bike being sold come with a salvage title though now?
OMVIC only applies to dealers. The ad photo looks like someones garage (i.e. a private sale).my issue is with the bike having a head on collision...being told that my bike is non repairable while i was on the couch..not seeing it.. and then seeing it for sale. Omvic should be made aware of the fact this bike had front end damage! It hit a car boys and girls.. moving! If it was repairable..should i not of had that option to repair it?

Everything written off is eventually sold at auction regardless of what the original owner wanted. He settled, now the insurance owns it and wants to recoup some money. I think there are a couple of insurance companies that do not want the liability of selling the bike back to there original customer. I am not sure of that but if that is the case no one has done anything wrong.
I don't understand why he wants to cause heat for the dealer now? The dealer said it has been in an accident, he is playing by the rules.

first of all... lets not get this twisted.. my heat? as you describe is not aimed towards the dealer.. I am also a dealer..fyi.. my heat is aimed towards the insurance! If i had an opportunity to fix my bike ? i would of kept it! Too see it after being told it was sold as salvage is wrong! .. I guess you are missing my point

well to be fair the dealer said, "it was laid down." i think if i was buying a used bike i'd want to know whether it was simply laid down or hit a car at speed
Insurance companies lie, like in this case they did to you. Private sellers and dealers alike also lie. Pretty much majority of the people walking this planet are liars and would **** you over for a couple of bucks. Welcome to life, the sooner you are at peace with this fact the happier you will be

The dealer is responsible to tell a customer if the vehicle was involved in a collision over $3000, structural repairs or alterations, or declared a total loss. Now I am guessing BamBam just called the guy and asked a quick few questions. At this point he hasn't lied (the dealer didn't crash the bike so he doesn't know specifics) a problem that would warrant involving omvic is if they came to a deal and those disclosures weren't made. The Point is right now the dealer hasn't done anything wrong so why call omvic.
