When I push my bike with engine off

Am I a driver or a pedestrian in the eye of The Law? Can I use walkway? Wear / not to wear a helmet? Cross intersections by pedestrian green light etc etc? Link to HTA? Thanks!
 
I do believe you become a pedestrian, much like a pedestrian pushing their bicycle across an intersection (which you are supposed to do as riding your bicycle across an intersection in the crosswalk is considered the same as a motorized vehicle using the crosswalk which is illegal). Whether you wear a helmet at that point is up to you though.
 
I think the question would be whether you were "operating" a motor vehicle. I think situational factors would have a lot to do with it. If your bike is not operable (flat tire, dead battery etc) I don't think you could be considered to be operating it. On the other hand, if you kill the engine, jump off and push the bike across a pedestrian cross walk, jump back on and fire it up you're likely to get ticketed.

There is a picket line at one of my customers. They let pedestrians (and byciclists) without delay, but cars must wait, sometimes 2.5h if there are several of them, in and out. I wanted to cross it by walking my bike, but need to know legalities.

There is a picket line at one of my customers. They let pedestrians (and byciclists) without delay, but cars must wait, sometimes 2.5h if there are several of them, in and out. I wanted to cross it by walking my bike, but need to know legalities.

Why don't you just park your bike and walk through the picket line then?

so do I especially downtown it ticks me off all the time and i'm a long time bicycle rider as well. The ignorance of bicyclists in the downtown core is stunning wrt traffic rules and their bicycles. I can guarantee that most of them have no clue they are considered a vehicle just like a car, maybe a very narrow one but a vehicle nonetheless and subject to the same rules as cars or motorcycles...grrr!!

I dunno. If I was a cop and irritated with you, I'd just charge you with HTA 172. :p

This question came up some time ago about pushing a motorcyle along a sidewalk. There was extensive discussion about it then. If I recall correctly the jist of it was that it would likely be a judgement call by the cop as to whether you were operating a motor vehicle or not.

This isn't a matter of legality. It's a matter of the picket protocol for that location and whether the picketers protocol is accepted by the authorities or not. If you expect the picketers to treat you differently because you're riding a motorcycle and not driving a car, you have another think coming. Do you think the picketers would let the cars cross if the drivers jumped out and pushed it across the line?

Maybe they'll think it's funny and laugh at the person? Maybe they can even help to push the bike??

I think her(?) best bet is to take her helmet off, shake her hair out over her shoulder, bat her eyelashes and ask the picketers to watch her bike for her while she goes inside. They'll probably let her park it right on the sidewalk and ensure no copper gives her a ticket, too. ;)

Edit: Unless the picketers are straight women of course.

Honestly? I think your best bet is to approach the picket captain and ask them. But, I expect they'll treat you as a vehicle. I would if it was my picket line.

Another option for you is to use your bikes ability to park most anywhere and park it then approach the picket line on foot.

When I ride a bicycle I do almost always and when I do bend the rules it's not flagrant and possibly life threatening. It's the act of considering yourself above all the other road users that gets me. If you are held up in traffic because you are in line in the left turn lane and it's moving slowly, you do not choose to ride around everyone and hit the pedestrian crosswalk to short cut your turn. You are not that special nor privileged. That's my take anyway.

I've used that method to get around gridlock snarls a few times around Spadina and Front.

I don't really see how one can be said to be operating a motor vehicle if the vehicle's motor is not running.
Are you operating a chainsaw if the motor is off and you are just hacking back and forth? I'd say, at best, you're operating a hand saw at that point.
Pushing the bike is more like operating a wheelbarrow than operating a motor vehicle.

Captain was asked, and said "no". This is why I Am asking for legalities - I just want to try and walk -why not, it is my personal time, I am not employed at that company, why should I care about ther issues, unless they gonna hit me or damage my bike.
(btw, my take on that - do not like the company or salary - quit and get a better job, or start working for yourself).

Well, what do you think happens if you're intoxicated and approach a RIDE checkpoint, you get off your motorcycle and walk it past the checkpoint? I feel pretty confident in predicting that you'll get nicked and charged with operating a motor vehicle while impaired. Having the ignition turned off isn't going to save you.

You may find that cops, like other road users, will become annoyed if you are trying to bend the rules to suit you. The problem is that cops can do something about it, when they choose to.
