The point is if you change someones life or end their life you should pay for it. Getting a stupid little fine is not paying for what you did. A criminal record and taking someones licence on the other hand is paying for it. More serious concenquences for your actions will make better drivers if not less retards out on the road.

The deliberate act to drive while drunk vs making a mistake with no intent to do anything wrong.
 
Its like what happened to my buddy, A guy repeatedly egged him on at the bar and at the end of the night they got into a fight and my buddy hit him once, Guy got knocked out and smashed his head on the ground, My buddy got 3.5 years for manslaughter for doing what anyone else would do in self defense. My buddy took it like champ and did his time without a complaint because he realized what happened and took responsibility for it.
 
Ex Friend jumped in his car 6 years ago HAMERED .. he crossed into merge lane hit and killed a Innocent guy....... Jail time was just under a Year....legal system sucks he should have spent a life time in jail in my eyes..

I'm not saying it's appropriately measured, just answering the question asked as to how the charges were laid with current laws... under the Canadian CRIMINAL'S Justice System.
 
^ not always the case. accidents DO and WILL happen, does it suck that people die? Yes. I bet you the man who killed my brother hasn't had a day gone by that he doesn't wish that he looked in his mirror twice. Do I want him to go to jail, lose his family, car and life? No. Accidents happen. Same goes for the driver who turned into someone else. It's an accident, and knowing that they killed someone will stay with them for the rest of their lives....

if you're burning through an intersection where you can't see the left turn lane.....maybe you should slow down so that you have reaction time; you can be damn sure that if you don't see the car, that it won't see you.

Slow down, smarten up, and if you don't know how to ride your bike without it wheelieing, take it to a damn parking lot first.

Just like the mexican that ran a redlight and t boned my brother on his interceptor back in 1985, my bro is still living but with one lung paralized arm and phantom pains from then on ...takes morphine that would disable you or I but still works 5 days a week...I bet that mexican fellow sorrows every day.... if i was the one i would be thinking i a,m so lucky i aint in jail for killing that biker!
 
The piont is more of a punishment is needed for not paying attention while driving on public roads in a 3-5000lb weapon, why not suspend a license at least? that person can still feel bad everyday taking the bus...no?
 
If you dont intentionally set out to kill someone, but your actions lead to their death in canada thats called manslaughter

Your actions need to already be in the criminal realm for manslaughter to be applicable. If you inadvertently bump into someone and accidently kill him, that's a simple accident and manslaughter charges would not be appropriate. While there may be an element of civil liability involved as far as damages goes, it's not a criminal act to inadvertently bump into someone.

If you deliberately commit a minor assault on someone and unintentionally kill him in the course of that assault, that's a different ball game. The assault was a criminal act to start with, and if death results, your criminal act has led to a death. Even if death was not a reasonably forseeable expectation of that criminal act, the outcome is what turns the original minor but still criminal assault into a case of manslaughter.

A momentary lapse while driving is not a criminal act. Even a sustained lapse is not necessarily a criminal act. It would be inappropriate to charge for a criminal offence when there is no criminal offence that fits, and even a death doesn't change the test. Even if the Crown were to lay a criminal charge on someone, the Crown still has a burden of proof to meet. The Crown must prove guilty intent beyond a reasonable doubt.

A simple case of "I didn't see the oncoming bike or car or bicycle or pedestrian" even if admitted does not indicate guilty intent to commit an offence. It just means a mistake was made, and not every mistake is a criminal mistake even when that mistake results in death.

I have no issue at all with overly-aggressive and deliberately reckless drivers being taken for the full ride if there is evidence that their driving was consistently "beyong the pale" in a prolonged period leading up to a crash. In those cases, you have a good argument that their unreasonable driving choices created a situation where the risk of crash increased dramatically.

However, that's far different from a person who DID look, even looked carefully, but simply did not see for whatever reason. Where is the criminal intent in that? How can you reasonably saddle someone with a criminal record when there was no deliberately overt recklessness or criminal intent involved?

A simple moment of imperfect performance is not necessarily grounds for criminal charges or conviction, even when death results from that imperfect performance. The driving or riding has to be shown to be extreme and obviously unreasonable, and outcome alone is not a sufficient determiner of that.

Doing things that you think are more important than doing the task at hand which is driving, and having no regard for others safety is a crime in my opinion, and people should get punished for it.

It all comes down to our licensing system... its a joke and that is why people don't take driving seriously. They think they are invisible in there little bubble. Until they are involved in a serious collision and they take a life or end up with injuries and chronic pain. Only then it effects them.

Forget suspending people licenses, make them volunteer at a rehab hospital for the rest of their lives.

Obviously when someone gets charged they are innocent until proven guilty. It would be up to them to prove they were not doing anything negligent. Not everyone would be guilty as you say.

You just contradicted yourself there; "innocent until proven guilty" then go on and say that it would then be guilty until they can prove themselves innocent. Innocent until proven guilty means that the Crown has to prove beyond a reasonable doubt that the offense was committed.

There are times when you do have to prove yourself innocent; reverse onus offenses... there are very few of those.

Yes, but if that driver payed more attention they wouldn't be killing anyone. A vehicle is a two tone weapon on wheels. I think the charge should be upped if they cuase grivious bodily harm or death.

When I'm riding the street...and I'm coming up to a light...I slow right down...move right and make DAMN sure there is nobody turning left at that light. If there is someone turning left...I slow down further so that I can stop if they decide to make that turn...or until I see them looking me in the eye!

Prevention works both ways!! :)
 
I agree and that is what I do as well because I have been hit before and know what it feels like(not on the bike though).

You got to remember they can even look you in the eye and still turn infront of you... you saw Goldies pics right???
