Because today we cuddle dummies and allow them to continue living with all sorts of safety devices. And when they do stupid things like spill hot coffee on themselves we allow them to sue and win

Just an aside: there was a whole documentary on this and how McDonalds made her look like a retard when there really wasn't a reason for coffee to be that hot at any point in time. I haven't seen it yet, but it looks like McDonalds won that campaign since she's often cited as the example of people who sue for dumb things.

Also, I'm waiting on that picture of the dude who was kayaking through downtown Toronto.

A former work colleague of mine took a hazard notices course at the University of Wisconsin, Madison when we both worked for a factory automation company in the GTA. He met the trial lawyer who handled the case for the woman who was burned. According to the lawyer, the woman was intelligent. The lid came off the cup and she was scalded. She was also wearing clothes that soaked up the hot coffee and that made the injury that much worse (a warning to all those polyester fans out there). And if my memory serves, the cup was also overfilled. The cups now have a maximum fill line I believe.

The coffee was insanely hot and the court determined that it was indeed McDonalds' fault. It strikes me that the effort by McDonalds had more to do with salvaging their reputation than actually defending themselves against the judgement. They did not want to lose customers.

I happened to leave the office earlier than usual yesterday. So got home, made dinner, and then the whole hell broke lose! Downpour, power loss...
Ended up drinking beer with the neighbour until midnight :D

"Hot Coffee" - Examines the dangers of tort reform using the now-infamous legal battle over a spilled cup of McDonald's coffee as a springboard.
