Stupid speeding ticket, 48 km/h over

Couldn't you get purolator or fedex to pickup the disclosure documents? Worth a call to the courts and purolator/fedex.

I can use purolator or fedex, but as I said I guess it would cost close to the ticket value. I understand that it could bump my insurance, etc in case they give me points, but I hope that plates ticket would not include points - only fine and since it's a minor offence it shouldn't bother insurance OR am I missing something? Please bare with me as I'm fairly new to the country and never dealt with the system here before ...
 
I believe that ticket is a minor offence which can affect your insurance. That plus the speeding ticket could potentially cost you a good chunk.

Points usually have no bearing on your insurance. To your insurance company, a ticket is a ticket, whether or not it has demerit points, it will affect your insurance rate.

Points have NOTHING TO DO WITH YOUR INSURANCE!

This plate ticket is EXACTLY THE SAME as a 40km/h over speeding ticket, as far as your insurance is concerned!

Fight it as if your license depends on it (and if your speeding ticket goes through, trust me, it will).

File for disclosure, do NOT put your phone number or e-mail address on the form. When you get the letter that your disclosure is ready for pickup we'll arrange to have someone pick it up for ya.

still didn't fax the request b/c I'm not sure if the service i gonna use (myfax.com - they provide the fax number etc) will be good to get the confirmation. I will be sending the request tomorrow, just wanted to make sure it's treated as a regular fax by the courthouse OR should I look for regular fax?

Any fax as good, as long as you get a date/time stamped confirmation page ;)

Just sent custom disclosure request form w/o my phone number and requesting all the info (notes, cop's ticket etc). The confirmation I received is as follows (is it enough?):

I would call the office to confirm reception of the fax. Ask the full name of the person you speak to who confirms the disclosure request fax was received.
That would cover all bases!
 
"It's been put into the prosecutor's bin"! Now I should wait for the mail when my disclosure is ready I guess. It seems it will not be ready for the first trial on October 25th, how do I postpone the trial date?
 
You don't postpone it. It's iffy given the late request but when you go to trial you state that you have not received disclosure, then ask for the charges to be dismissed. If they try to give you disclosure on the day you say no, then state to the JP that The Crown has brought your disclosure, which you have not been afforded time to study in order to prepare for your trial, and ask for a later date so that you can adequately prepare your defence.

I will be in Sarnia this week, probably Wed or Thursday. Could I pick up the disclosure for you and than fax it to you from my office? PM me and let me know either way.

Remembering, of course, that any delay created by this situation should hopefully be blamed upon The Crown, which should also go toward a 11b petition.
 
1 more question: I've noticed that I can ask for interpreter in court (English is not my first language) - can it be wise to do so (maybe they don't have one available or need to wait longer, etc?)
 
IMO that would be unwise. Based on this thread you speak good enough English to make it through court proceedings (especially if you get representation). If you've already sent correspondence in English that may be another issue. The interpreter option is if you don't speak good enough English to get by in conversation.

Any delay will also be laid on your feet and that doesn't help you in the long run.

Actually my mother did that a couple years back for her Honda Vespa accident. We have Russian background. She requested a translator and it was in her favor. Don't matter how many years you been here in Canada.
OP from personal experience, Yes, if you can request one. Do it. Cause if they can't supply it......tough luck for them in a way.

No...that's what I was saying. If you decide after your trial date has been set that you want an interpreter, the delay is on you and you ruin your chance of an 11(b)
