Pretty sure my bike is totalled

Funny thing is I have the Huzar high mount exhaust coming in the mail right now.
But in this case the heavy stock can saved my leg. If I had the high mount tucked up nicely he would have caught my right leg instead.
If it's written off I'll have some nice aftermarket bits for sale.

Good point about it saving your leg, looking at the pics, it doesn't look too bad, between hitting the bears, or being the rider in the back, I'd say you got fortunate.

That said, if the bike gets scrapped... didn't you get a seat concepts seat? I may be interested in doing a trade or swap for the stock one if possible. I've been waiting for the SC one piece, though that maybe a while away
 
I'm a wee bit upset about the t7, it's less than a year old. However, given the circumstances I'm fine with it and insurance will make me whole again on that end.

Not to seem insensitive, but will insurance go after your friend, because technically, he rear-ended you?

My buddy hit a deer and the OPP charged him with a highway traffic offense. I think it was careless driving or something like that.

They laid the charges on him while he was lying in the hospital bed... :mad:
 
Really unsure. Availability is a real problem this year as well.

That does bring up an interesting question. Do you have replacement value on the T7? Insurance is supposed to restore you to your condition before the crash. A one year delay to get a bike is not reasonable. Can replacement value exceed MSRP if that is what is required to get you a bike in a reasonable time period?

If he does choose another T7, it appears a few dealers have some in stock

Cops might. Insurance doesn't normally push for charges even in fraud cases due to privacy or just not gaf. I suspect Animal involvement plus cops not wanting to deal with much during pandemic should be sufficient to avoid charges in this case. You are always rolling the dice though.

Will his company go after his buddies as an at fault situation to recover the monies?

Probably but that likely doesn't matter. Buddies HD is probably in rough shape so he will have an at-fault (probably, it was a moving animal but he didn't hit it so normally that screws him) and a claim already so the size of the claim is immaterial.

Some weird laws. I just got my ICBC motorcycle instructor's permit and I learned that during the road test, if a pedestrian jay-walks out in front of you and you brake to a complete stop, that's an automatic fail.

Acceptable actions are "slow/swerve to avoid" or "hit the pedestrian".

No lie.

Well the police didn't charge him for rear ending me, they just said it was the bears fault. However the insurance will likely see it differently.

Was the deer alive or already dead on the road?
I smoked a live deer that jumped out in front of me, no charges and the only concern the police had was if I wanted the deer or if they could have it.

Normally hitting a moving animal is no charges and not at fault. Dead animal is at-fault and can catch a charge.
