Just some food for thought... few years back a friend of mine had the same situation... they ended up going down and she sued him... SUCCESSFULLY... It was originally a $750,000 law suit... not sure what they actual settlement was though.

No gear, no ride.
Sued for what?
Did the rider not have any insurance? Was the ride convicted of some serious careless driving?
 
I'm guessing the passenger sued for pain and suffering (and various medical expenses). The rider's insurance likely paid the damage amount.

You got it. He did have insurance... it was the insurance company that she sued but he was obviously named in the suit as well.

So like I said... just something to think about. It can happen... and they CAN win.

Sure the money didn't come out of his pocket, but its still a long and drawn out process that no one wants to have to deal with... I can only imagine if someone rolled the dice without insurance or didn't have enough liability coverage... say bye to your house I suppose...

I'd never allow a passenger (regardless of how hot) to squid, even if she said she knew the risk and was OK with it. Ultimately if anything happened, I wouldn't be OK with it.

It isn't just about what's legal. It's about what's right. And, in regards to your reference to seatbelts - no one rides in my vehicles without wearing their's, regardless of age.

An interesting point about that - do you really want 100kgs of unsecured meat flying around inside your vehicle in a rollover? I've seen the results, it ain't pretty. A body flying from the back seat can take the head off a person in the front.
 
I make my passengers ride gear. I have gear for XS, S and M sizes in women's gear.... I have jacket, pants, helmets, and gloves but no boots. I figure they have there own pairs of hiking boots.

gear is the right thing if nothing else you will look like a DB riding in gear while the passenger is in a T-shirt (He can't give her his jacket, what a DB!).

We're talking about the rider being fully geared and the passenger not. What's right in this case is clear to me.

We weren't talking about what people in third world countries do where they ride without helmets, seat belts, or tires with tread.

i dont think riding with or without gear is as black and white as right or wrong. no one ever said riding without gear is wrong, its frowned upon by a lot but its an everyday thing for the rest of us. the one thing i do agree with the ATGATTers is that maybe she doesnt know the TRUE danger of riding even though iv explained it to her many a time.

its kind of like smoking, its "wrong" because its bad for your health but people still do it with the risk of cancer. if someone (of age) were to ask me for a smoke i would oblige, why? because they are an adult and can make their own decisions
