I just got back from a weekend in Cleveland and just the number of riders between here and there without any sort of gear was enough to shock me. All on the other side of the border of course.
 
Out of curiosity, who is responsible for the passenger's helmet?
Depends on the age. Can't remember if it's 16 or 18, but under that and the driver gets the ticket. Over that, it's the passenger. I'll try and find the exact answer for ya.

*Edit: It's under 16 they charge the driver, 16 or over the passenger gets the ticket =)

Awesome, I would hate to run their look when they just turned legal.
 
Back to what I originally said for a sec; what if you are involved in an at fault accident while taking a passenger? Maybe I'm too pessimistic but couldn't the passenger sue you for injuries and what not? This is a worst case scenario obviously.

Isn't this what liability insurance is for?

I would assume they could sue you if you were deemed at fault.

Then wouldn't passengers in cars be suing drivers every day?Are drivers not protected to some degree financially with their insurance?

in that case - everyone involved in the collision that was injured will be getting coverage by the insurance companies involved - most likely covered by the drivers policy of whichever car/bike they were in/on.
 
Wait, a passenger can sue the driver? Does this also apply for cars? I mean... its not like you forced them on...
 
I have a neighbor that was involved in a car crash while a passenger. The crash was entirely her "friend's" fault but her insurance was refusing to pay for my neighbours injuries and such. She can't work (but raise four kids with two being under 6yrs old, but that's another story) because it screwed up her arm, she was a waitress. A few years on and she finally received a settlement, but it was all paid out to her after hiring a lawyer and forcing the insurance company.

Of course they still have to win the lawsuit and unless you were drunk or driving erratically, would be a really hard sell. The Canadian legal system is "smart" in that most Judges will hold people accountable for stuff that has implied dangers/risks associated with them, so claiming they didn't know what they were getting themselves into is only going to make them look stupid.

But looking stupd isn't going to prevent them from getting a settlement. If I were a lawyer I'd be happy to take on a case where the rider was fully geared and the pillion was wearing a thong and a helmet. I'd like my chances of a pretty good settlement for my client.

It all depends. Our system doesn't work like the U.S. legal system in that you can settle for just about anything. Given the defendant has a decent lawyer, it would be a hard sell. In the end your settlement would be nothing and your legal fees would outweigh your winnings.
 
Just some food for thought... few years back a friend of mine had the same situation... they ended up going down and she sued him... SUCCESSFULLY... It was originally a $750,000 law suit... not sure what they actual settlement was though.

No gear, no ride.
