While private sales generally dont' fall under provincial legislation. This one might be a bit over the top.

Whether it'd stand up in court I have no idea. Saying it though should help sort the good buyers out from the timewasters.

Well I would probably not buy from someone that tried to impose that, maybe that makes me a time waster to you, but it reeks to me

I can see that.

From a sellers point of view though it ties a buyer in. In the interim a seller could kiss other buyers goodbye because they think they have a sale.

I can most def see what you're saying and it may appear that it's undue pressure on a buyer. That certainly wouldn't be my intent.

No, its not undue pressure, its simply not commerical

One. the combination of cash in hand + no refund for deposit means that sitting on the bike = buying it. That ridiculous
Two. it implies that if the Seller wants to back out, they can keep the deposit.
Three. It implies that any conditions on sale (such as mechanical inspection) not being met resulting in the sale falling through, would still result in losing the depost (unacceptable)
