If one of the vehicles is parked (and unoccupied) and the other is moving, then it is pretty hard for it to not be 100% the fault of the driver of the vehicle that was moving. Parking lot incidents ARE NOT automatically split fault.

And yes, I've been there. My car was hit in a parking lot while legally parked and unoccupied. Didn't cost me a thing to get it fixed and it's not registered as an at-fault claim.

Even if you are driving in a parking lot and get hit, if it is the other persons fault then you don't pay. I had some idiot lady run a stop sign in a parking lot and t-bone my three month old car.

True.. Been there for a friend who went through the process (had the r.o.w., the other person ran a stop, t-boned the car).. 100% other guy's fault. Some people should look over the fault determination rules.

Looks like her and or her parents will be paying for it in cash. They did not want her to have a record and insurance claim.
You guys can have her. I did not find her attractive. I guess she exploded like that because she did not want to be alone.

I hope you took pics of the damage of both your bike and her X3.
Whatever you agree upon, get it in writing, with witness signatures and dates.

Shot in the dark, but was her mom hot? Pics?
 
IV, I'm glad you weren't injured... bikes can be replaced. After she buys you a new bike, be sure to stay away. She sounds like she has more baggage than most airport carousels... like the type to keep the condom after sex only to try and impregnate herself with it... bitches be crazy, and she's their poster child!

Make sure that they don't back out of it and or keep delaying you. Even if they offered to pay in cash I would definately consider going through insurance to cover your *** and make sure you get what is owed to you.

And that's why pro-athletes, celebrities etc...always flush them or take them, never just throw them in a garbage can in the bedroom
 
if they are paying cash, just let them know what a new bike costs. get it in writing, see if there is video footage from the parking garage. they probably think it is a small repair, just be clear about it...and don't let them stall...and remember, you only have so long to report it to the collision center...remind them of that.

good thing you walked out when it happened, otherwise she probably would have run...you are the lucky few, now go buy a lottery ticket...
