laying here at 3am, cant sleep...could have been killed

the real pain usually doesn't kick in until the next day...hopefully its not too bad.

You should have at least kicked off a side view mirror or something...

Take it easy for a few days. Glad it wasn't worse.

The Toronto police drew the threshold at immediate transfer to hospital. It doesn't matter how hurt people are, it matters whether they hop in an ambulance. Moral of the story is every bike accident deserves an ambulance ride to the hospital so they are appropriately documente.

Not sure anyone even dialed 911, OP wasn't clear about that.

Get well soon and good luck

Wouldn't it be great if they could lay charges such as "assault with a deadly weapon" in cases like this because that's exactly what it is.

That's criminal negligence to be texting, driving & being a new driver. That's equivalent on giving a 10yr old a gun & tell him to run through a crowd full of people

Glad to hear you are ok. I'd still go get checked out at the hospital, and sometimes things don't show up until later. Depending on your own insurance coverage, you might still get something covered should you need treatment IF you get checked out after the accident. I know the one time I was cut off and dropped my bike (wish I could forget, but luckily almost no damage), I managed to put it down slowly, and continued to ride the rest of the day. It didn't hit me until late that night when I was at home.

As for the ambulance required for police...didn't know that either. Hopefully I'll never need it, but I'll keep it in mind in case I ever do. Does anyone know how other cities/regions/municipalities handle it? I hate to tie up resources too, but if it is a requirement to get the police out and charge someone who was driving dangerously/carelessly, or on their phone...I'd do it in a heart beat.

Only thing that doesn't make sense is that it was a new driver in a rental? I thought all rental agencies wanted a G2 or full G to rent a car, but I could be wrong. Then again, I've heard stories where someone gets hit and the person can't speak any english, is a new driver, etc...and once the police show up suddenly they were born here and speak perfectly (while also not being at any fault....of course).

Good call. I believe it's also an order of magnitude of running this scissors.

The police no longer respond to collisions unless there is an injury.
This is a cost cutting measure by the police, the insurance companies and the various levels of government.
You are incorrect. Every call to police involving a motorcycle collision is dispatched as a priority call unless it is known that there are no injuries (in which case an officer is still dispatched but not in priority over more serious calls).

I am almost 50 and 250 lbs....i keep thinking I should hurt way more than I do...very lucky.

suspect you will tomorrow.
From your description you might have some joints that went the wrong way or too far That might show up. Sounds like you were still on the endorphen rush which keeps you from feeling hurt. Get to the docs asap.

Good on you for getting out of that. That is my worst fear getting hit from behind.

There have been several stories in the media of late about making breath machines in cars mandatory to cut down on impaired.
How about making interference generators mandatory so that you can't text or talk inside the car?
It seems this would cut down on many more collisions.

Fit all cars with mini EMP devices? Maybe it'll prevent radar and lidars too lol

I was wondering the same thing. The Police at minimum should have been called and a rear ending (even with no proof of texting) would normally be charges right there.

Jeff
If the OP didn't call the police I sympathize. I was rear-ended but not knocked off bike. Instead, my bike lurched dramatically into an intersection and I managed to hold on. Even without falling off I was still sufficiently shaken that it did not occur to me to call police. I exchanged insurance details, etc., then called friends who all agreed--careless driving, should've called the police, get that guy charged. Now, though, I have a protocol which boils down to...any contact not my fault, call the police. I've seen a sensible recommendation that the post-crash actions be written down and carried so one can remember what to do.

Anyway OP, glad you're mostly okay and hope you are back riding soon.

Would probably kill your own vehicle first before anything else...

Wow, what a lot of replies, quite overwhelming! You guys are all great.

I really did not think of calling 911, I was too busy trying to ensure I had all the other guys information and that it was correct. I had a witness, who came to me right away, and got me off the idea of physically harming the other guy, and immediately shifted my attention to my bike, helping me get it off the road...the bike is not totaled by the way. The witness gave me all his information.

It was a very slow crash. I had just edged forward, put the bike in neutral, was slowing to a stop, at about 5kmph, feathering the front brake and there was a sudden huge amount of kinetic energy, the bike lurched forward, I tried to keep it up, but there was no keeping it up as I was in flight, the bike stayed upright until I was off it. and on the ground. I never thought of calling 911. I felt ok, bad actually for holding up traffic. I just didnt think about it even for a second. The guy who ran into me was begging me to not go thru the police, he would have given me a bj right there on the road. Probably you are right, I should have called 911.

No one disputes anything. The car rental agency provided the insurance info right away. The reporting center, insurance company all said no fault accident on my side.

I made an appointment to go to the doctor tomorrow.

I always check my rear mirrors, often often often...but in bumper to bumper traffic? When we are all going 5kmph? It did not occur to me, to be honest...

Thank you all for your comments, I will read them more thoroughly when I get home tonight.

Cheers,
M

There's a reason he didn't want cops, he probably has been charged before with other infringements, perhaps expired licence who knows?
As much as I can be a sympathetic person, theres consequences.

It's pretty damned easy to make the compartment of cars into a faraday cage to prevent any signals from reaching your wireless devices. Unless it was mandated, no automaker is stupid enough to be the first to try. It is also not that hard to defeat for a specific frequency band (external antenna w a repeater in the car, you may even be able to get away with a tuned pair of antennas and just use passive transmission).

Well if it was a rental, then if he had rental insurance, the accident won't raise his rates and if no ticket then it won't affect his license or insurance either. Had the cops been called in, then it could have done some damage to him financially.

Not defending him in any way (I believe police SHOULD have been called)...but just saying it is a possibility.

Always call 911. Ive been screwed over so many times by not doing this. Police, fire, ambulance. You want all 3. Ideally you should just lie on the ground and not move until one of the 3 get there and can put a brace on you, because you never know what might be messed up. If you had called, the guy probably wouldve been charged and you wouldve had a real case.
Honestly im not very optimistic about this one. No police called means your word against his. A witness is better than nothing I guess but its not much. Not worth as much as you think it would be. The main thing a witness is good for is giving a statement to police when they show up. But since none showed up....Idk. I don't expect this to work out, but I hope it does.

Hope it goes well for you.
