Westbound Gardiner, yonge St south ramp.

Bumper to bumper traffic, I was rear ended.

If I had stayed in the right lane, yonge north exit and went right to the front of the traffic and budded in at lakeshore, my wrist and shoulder wouldn't be stiff...and my back wouldn't feel like I have been lifting heavy ****.

The witness said I was incredibly agile.

I was hit from behind and felt this force like a charged rubber ball. The bike was pushed forward, but I could not control it. The force sent me flying over the bars, as I was starting to go over my torso pushed the tank bag forward which cracked off a big piece of my windshield and front fairing. Somehow, and I don't remember doing this, I shut off the engine via the kill switch. I was on the right hand side of the lane, the bike dropped and slid as I flew into the center of the yonge northbound exit lane. I stopped my fall mostly with my right hand.

I wear lots of gear. I had on gloves, heavy leather jacket, underneath speed and Strength armored hoody and speed and Strength armored riding pants with kevlar lining and knee pads. And a Shoei helmet. Helmet did not touch the ground. There are no signs of damage to my gear. I am fine.

If the drivers in that lane were driving and texting just like the guy who rear ended me, they would not have stopped and I would have been run over.

My poor bike.

I just finished detailing the bike and waxing...scrapes on one side of the fairings, road rash on the bar end, mirrors, front brake lever (Nissin, after market). Scrape on the frame, exhaust, bent rear brake lever...I could go on...christ!

The driver was "sorry." New driver, Ontario licensed, foreign student, car rental.

I am hoping to press charges and get him OFF the ****ing road. Sorry for the venting and bad language.

No, I will not settle this privately as you begged me to do while my bike was laying on the road. I have already filed my claim and am reporting first thing tomorrow.

If I can press charges I will. You will be my next project.

I will find out at the collision reporting center what I can do, if anything.

Not really injured, I feel fine. I keep track o my blood pressure, and it is 107/69...the lowest it has been all week...go figure.

I am almost 50 and 250 lbs....i keep thinking I should hurt way more than I do...very lucky.

My anger is keeping me awake tho. Riding is such a joy to me and to think it is dependent upon complete idiots who have no concept of responsibility. It scares me to count on these people to drive safely. to trust them
 
It's a real danger out there. I tend to watch my mirrors like a hawk while stopped because of instances like this. It has saved my butt on two occasions. I hope you get well soon, glad you are still here to write about it.

It's criminal in this province that we are not allowed to filter up through stopped traffic to avoid these exact situations.

Maybe if more real world stories like this were presented to the idiots in parliament over and over again they might start to get it, doubtful but just maybe.

Glad you're OK, but just a heads up from someone who's suffered his share of traumatic body injuries over the years - you'll feel it more today and tomorrow.

I will find out at the collision reporting center what I can do, if anything.

Wait....you were rear ended, knocked over your handlebars, your bike trashed...and nobody called 911 and had police and ambulance show up?

I wouldn't have left the scene until both attended. I hope some witnesses gave you their info so this guy doesn't suddenly go from "sorry" to "that didn't happen".
 
Sorry to hear about your accident. Your gear for sure helped you out. Unfortunately I too know what's it's like to go over the bars. Make sure you follow through with your insurance company and also with the police. Also, usually a few days later you will feel the brunt of the collision so be sure to follow up on the medical paperwork etc.
Hopefully you get sleep soon.

Agreed. If police didn't come and you have no witnesses then how will you prove that you were right and the other driver was at 100% fault? The other driver will have his/her own story at the collusion centre (after going home and talking to others about what to say). Unless you had a camera or have witnesses, I think it would have been better to call 911 right away in this case to get checked out and should have let things get document on the spot. This is the time to make use of the taxes you pay for public services or risk being at fault regardless of the truth.

I was wondering the same thing. The Police at minimum should have been called and a rear ending (even with no proof of texting) would normally be charges right there.

But TPS wouldn't come unless the OP took an ambulance ride. It's ridiculous that in their quest to save money, you have to waste more public money to get the police to care.

It's a major accident IMHO. If I got knocked off my bike by someone the last thing I'd do would be to dust myself off, pickup my bike, and ride home.

Sorry OP, please don't take it personally, but I would have laid down somewhere and said call 911 and got that ambulance ride - on this situation you're typically in shock and you can be unaware of things you've hurt.

Hopefully the offender cooperates now.
 
Glad to hear you are okay. Please keep taps on your body in the next few days.... the aftermath usually comes days after and you may feel like you got beaten up all over.

Hope you had witnesses and their contact info.

Emergency responses are super quick on the Gardiner, especially when they hear the word "Motorcycle" on the radio.

And that's a gaping loophole fraudsters have been driving through ever since. It doesn't stop the police from getting angry at the collision centre if you forget even one of their regulations though! Not hard to do when you're shaking with adrenaline. Been there, know how it feels, OP. Glad you're still here to post. Get better and get used to checking those mirrors more often. With the proliferation of touchscreens and gadgetry in automobiles, distracted driving isn't going away. Absolute insanity in my opinion but our betters in the Fiberal government believe otherwise.

The guy went flying off the bike, no one would have known on the spot if there were no injuries (external or internal). He deserved to be checked out on the scene and police would have came if he called 911. Highly likely the deriver would have told the truth at that time. Now it's all based on the statements from two different parties and the insurance companies to tell the OP if he was at fault.

Op glad your "relatively" unscathed. You can't "press charges" against the driver, only police can, decide in traffic collisions if a charge is warranted. Too late now but you SHOULD have called police this was a PI, (personal injury) accident. You need to go see your doctor today, you have already said your in pain it WILL get wort in the coming days. Took three days when I was rear ended before I started to feel the real effects of my injuries.

I con't comprehend though how if you were rear ended, you went over your handle bars, NORMAL is for rider to lunge backwards not forwards from the impact unless you grabbed a fist full of brake lever when you were hit. I was hit by another bike, (he rear ended my bike), traffic cops determined my speed, (on the 401 stop and go traffic), to be approx 40 km the other bike locked his brakes and was estimated to be doing 125 - 140 as he hit me. He was riding a GSXR 600. I was on a roadstar 1700 Cruiser. I kept my bike upright, he went down. The most significant injuries for me are both shoulders, one elbow and one hand, (Clutch hand), as well as neck and shoulders. As the doctor said consider the force with which your head with the extra weight of a helmet snaps back when your hit by something traveling at approx 85 - 100 km per hour faster than your traveling.

My other advice is contact a PI lawyer today. They will take the case on contingency, (No upfront money) but most importantly they will advise you how to proceed, which doctors and pain people to see, etc.

You can bet the rental company won't let this guy "settle it between yourselves" They WILL demand it be reported and their car fixed properly. They can't rent out a damaged car, (sounds like there should be significant damage to the rental). You want HIM and the insurers, (Either his or the rental company) to pay for damages you don't want them coming after YOU.

Hope you get better soon man. Plus that driver broken 2 major laws there. Plus if you are new & break laws you get taken off the road for certain amount of time

The Toronto police drew the threshold at immediate transfer to hospital. It doesn't matter how hurt people are, it matters whether they hop in an ambulance. Moral of the story is every bike accident deserves an ambulance ride to the hospital so they are appropriately documente.
