Isurance wants my gear after 2 months.

Something tells me they don't want my jacket anyways :D

They don't want it to use. If they paid u for it they will take it. It's like when they pay for your totalled bike they don't let u keep it too. So much fail.

Oh I know what you're saying but if after 2.5 months they come asking for it, sorry, it's gone. IF they wanted the gear that should have been stated immediately during the "we're going to replace your gear" conversation

Never complain about the cost of insurance in Ontario then, your kind are the problem.

Just give them the gear. If they ask why you still have it, just say it has sentimental memories of your life-changing visit to Ancaster.

Helmet has an 1" minor scratch. Jacket and vest have scratches from the fall (totally rideable), left shoe has a small ripped. Backpack has some scratches. Told them that gloves were thrown away. So technically evidense are there. I just really love my jacket, it also comes with riding pants (2 piece suit) that I wasn't wearing at the time.
Either way, glad that I always wear my gear. Walked away without a scratch from that nasty flip.
I guess I got a little bit greedy, not that insurance rape us all the time :-/
Thought I could benefit from them.

Great post.. Way to ADMIT to insurance fraud on a PUBLIC forum. You have stated you kept the gear as it is still usable, and you were "trying to benefit from them"

Now I am sure you think your safe as you haven't provided any Personal identifiers. But a decent insurance fraud investigator could track you down easily with the following info:

1. accident happened in June 2013
2. Bike was a total loss.
3. claim was for bike and the gear as you mentioned it all above including the specific jacket brand name
4. your adjuster called, (within the last few days), looking for damaged gear, (insurance companies keep notes on EVERY call they make to a client).

Now there might be say 100 claims that meet two of these criteria, but to meet all four there is likely only ONE claim... yours.

Now would a company pursue fraud charges for this small amount? Not likely, BUT they may very well seek restitution for the gear, then they will drop you and it WILL be recorded that you were dropped for insurance fraud... Good luck on getting a new policy from anyone, especially one that you will be able to afford.

I guess you should have:

1. been less "greedy"
2. sent in the gear
3. NOT posted anything about this on a public forum. You can rest assured the insurance companies visit forums like this.

Thanks for help brah. They can track me all they want lol. Yes, the gear is going to them. I just love my jacket that much that's why I'm not too happy. Why can't I be greedy? I have all the right to be greedy with them. I pay good money for insurance that is why I'd love to benefit from these crooks.
Came to share an experience (and hopefully people will learn from this for future) and ask for some guidence just to get $-hit on in return. This is why I do not like posting on this troll based forum.

After an accident people have up to 3(maybe 2) to lay claims against you, so the claim is left open to a degree. Is there nothing in your policy stating this procedure?

Had a bud in the exact same situation, the payment for the gear was reclaimed by the company (couldn't prove the gear was damaged) and they "denied" (aka too expensive to renew) him a new policy

So you claimed your motorcycle...... expected a replacement
and you claimed your gear...... expected to be able to keep it?

In a way yeah. I have never gotten in the accident before therefore have zero experience with this stuff. But then again they absolutely said nothing about returning my origional gear to them back then. This all just came up yesterday. It's cool, I'll return everything they asked for. Sales on gear at stores are going to start soon, thank God.

Good to know. Everything I claimed actually did get damaged but to the point where it was reusable.

You CAN be greedy all you want. it only serves to increase EVERYONES premiums when people try to cheat the system, Including mine. Then you expect those of us who pay higher premiums to cover your greed to be happy about it?? GMFAB. You posted that you expected to get paid for the gear AND keep the old gear, (remember you were the one who said the gear was still "rideable") , so obviously you planned to continue to use it AND keep the new gear.

You got piss*d because they asked for what was legally their property, (they paid you for it). Now should have they asked for it back sooner? Yes they should have but it could be it slipped his mind at the time, not like yours is the only claim he was dealing with.

So go ahead be "greedy" but as others have said don't piss*d when your premiums skyrocket, because everyone else feels they are also "ENTITLED" to be greedy. Perhaps if people didn't feel so entitled our insurance would be much lower. But glad your sending it in. Personally I would NEVER reuse gear that was already in an accident, but guess your not as concerned with safety as others are.

Insurance exists to give you a fair compensation during an accident to stop you from being significantly financialy impacted from it. Its not for you to make a Net profit on. In most cases you won’t even breakeven but you probably won’t go destitute. That’s the nature of the product you pay for.

You dont have a right to be greedy Legaly. IE insurance fraud is a cirme. Now I am not saying what you did was intentional fraud but we are still talking about what $500 - $700 dollars’ worth of equip that you claimed that you probably didnt need to.

You already benefit'd from the product you paid for. From your Medical costs and bike repair costs etc. On your premium they lost money.

When people take extras of insurance IE benefit fraud it causes our rates to increase. So remeber that when you complain about the prices crooks.

no sympathy for the OP, deserves to pay a high premium because of crap like this. Stop treating insurance claims like a free for all. Replacement is replacement, man up and deal with it. BTW, which insurance company is it? Maybe we can all turn in this thread to get ourselves a discount on you.

I love this forum. Bunch of church going saints who have never done anything to benefit themselves here. I've been in the car business most of my life and I've seen TONS of people claim things a lot worse than a couple hundred bucks. Insurance is high here because the gov't allows the scam to continue because their pockets are being lined. Give it a rest. His one claim for gear which he said he's sending back isn't changing the world. Bunch of friggin drama queens

1. What does this have to do with the "Darwin Award" ?? That is for people that kill themselves in a stupid/silly manner.

1-) I guess most people in here are such outstanding citizens that they never do anything wrong and jump at the opportunity to look down on the mortals and their human faults.
2-) Dude, seriously you claimed a **** load of money, including your back pack (way to be greedy) and weren't even prepared for a call asking for the gear, even if you didn't think it would happen at least be smart enough to have a plan for all possible circumstances. You committed a crime (insurance fraud) and didn't think there was at least a 1% chance they would ask for it back?
3-) Tell them your mom without you knowing put it in the garbage and when you went to get it after your conversation with them it was no longer there. Don't be surprised if at renewal time you get an anal exam from them.
