Isurance wants my gear after 2 months.

Long story short. Had my bike written off sometime in June. Claimed my jacket, helmet (that had a minor scratch), gloves, Icon douch-vest, riding shoes, backpack. All in all insurance paid out for everything withing a week and didn't mention anything else.
Today after like 2.5 months I get a call from the same claims guy and he said I had to bring all my damaged gear in.
I understand about the helmet but everything else is def usable and I would hate to part out with it.
Why was this "bring the gear into our office" was not mentioned back then? I mean not a word about it.
I feel like if I tell them "I don't want to give away my nice JoeRocket jacket" they would say something like "Well give us that $360 back that we gave you back then".
 
Your insurance paid out for REPLACEMENT gear, not a new 2nd set for you to enjoy, just like they became the owner of your bike when they paid out on it (do a check on the VIN and you'll find it in their name). Check your policy, I'm sure you'll find the clause in there somewhere.

Although I agree; it should have been mentioned at the time of the claim.
 
What would you do if said gear was thrown away once you got replacements? They should have said something at the beginning

That's exactly what OP should have said when the request came after all this time.

So you claimed for Damaged gear that wasnt Damaged?
 
Just say you threw it out. Do they expect you to keep damaged gear at home for 2.5 months.

Helmet has an 1" minor scratch. Jacket and vest have scratches from the fall (totally rideable), left shoe has a small ripped. Backpack has some scratches. Told them that gloves were thrown away. So technically evidense are there. I just really love my jacket, it also comes with riding pants (2 piece suit) that I wasn't wearing at the time.
Either way, glad that I always wear my gear. Walked away without a scratch from that nasty flip.
I guess I got a little bit greedy, not that insurance rape us all the time :-/
Thought I could benefit from them.

Its that kinda stuff why insurance is so high here. People overclaiming on Health and repairs etc.

Anyway glad your ok. I would just tell them you threw them away as they were useless.

Helmets should pretty much always be replaced after the incident anyway if there was any contact.
 
Just say you threw it out. Do they expect you to keep damaged gear at home for 2.5 months.

If they do tell them there's a daily storage charge. That's a good enough answer for the crooked insurance companies, why not for the people paying them :D

Well in cases like this you really don't think of the whole big picture of how everyone else is getting screwed. That guy caught off guard with telling me to bring all the stuff in. Didn't even get to think about it. Also riding shoes are due to replacement (Speed & Strength "Ride with the Bulls"), they are nice to ride in but their sole is worned out after only one season.
For helmet I'm gonna probably pickup RF-1100 that are on sale.

I would think that if they find that your gear isnt damaged from the accident they might raise a real stink for you. I dont know if it will go as far to say fraud but be on your guard.

No one told me to hang on to anything when my accident happened. TD has been more than slow at getting this all settled with me and not that my gear is useful but if they ask they're going to get a :thefinger: from me with directions on how to do so.
