I've said yes the last few times I've been stopped. No big deal. They knew I wasn't lying or worried and they just let me go through.
 
Well, if you're under the limit you really have nothing to worry about, do you?


And my question is have I had anything to drink since when? Until I hear a legal definition of what is considered the length of time threshold between a drink and none, my answer will always be no.

I always tell them: "no booze since Grade 4".
 
Not sure what you mean? That the RIDE program is a bad thing? Yes, it can be a bit of a PITA, but what is the alternative? Lots of people drive to the liquor store loaded, so it's a place you can expect it to possibly be set up.
I believe an MP has the same powers as any Police Officer when he is on the base. If you were foolish enough to lie to him because it is inconvenient, as has been suggested, that you had not consumed alcohol and he knew better by the smell, he would breathalyser you and you would be charged with a more serious offence regardless of whether or not you were under the limit. Yes, it is inconvenient. It sounds as though the MP was misinformed about the laws. If you were in your car, then there should be no problem. If you were on your bike with a M2, then the legal amount is 0%.
If you are charged on your bike, it would affect your insurance on your car.

Don't have any issue with the RIDE program. Think it's a great thing!
Have no issues with cops usually either. And, I have no issues with telling the truth.

This, however could have turned bad for me if he thought he was in the right and did charge me. So there I get a suspension, truck impounded (I believe) AND since I'm on course right now, I would have also been charged under a military charge :129 and been in **** there too, all for a cop not understanding a law that he is supposed to be able to enforce.
What course of action would I have to get the suspension taken off my license, keep my insurance the way it is and also have my military charges dropped? I would for sure be going after someone!

I guess "luckily" he let me go after a bit of harassment for me being totally legal and honest lol.
And the pigs wonder why people hate em.

This is nothing compared to the time I was stopped for a cop thinking he saw marijuana smoke blowing out the window of my moving pickup IN THE DARK, and after explaining to him I've never had a toke in my life (which is true) and haven't ever even smoked a smoke (also true) he then ripped apart my truck LOOKING. Then harasses me about my dirt bike in the bed, checking ownership and then continuing to call the VIN on the radio to get it checked. Then, when that came back legit he had me sit in the back of his car to do a breathalizer... Which surprise, came back as a 0.0 after I said I hadn't had a drink.
THAT guy was asking for the lip I gave him the entire time that he took to show me how to use the breathalizer (surprise, you just blow in to the thing).

Made me 45 minutes late for a date, so by the time I got there she wasn't in the mood to put out...
 
Haha! No, I'm serious! What's the point of that law? You can drink in a limo. If they're worried about the driver being drunk, every car has a breathalizer. Just test the driver! I suppose this is the gov't saying that the driver can't be trusted to not drink with the temptation there?? We manage the designated driver thing. Is it really that bad?!?

I wouldn't bet on it just because people have done it. Maybe one of our legal Gurus can clarify but my interpretation is you can only drink in a residence, a secondary residence*, or licenced establishment or area (Beer garden). To be licenced I suspect a toilet is mandatory.

we rented a bus style limo last year in it was licensed to allow alcohol...

That might happen in a communist country. But I think in Canada we have an opportunity to defend ourselves in court...well...unless we are charged with HTA 172.
 
Not familiar with the bodies ability to dissipate alcohol but if you had 1 beer 3 hours earlier would it have still registered on the meter if they forced you to blow?

The general "rule" is a drink per hour to be ok...
I think there might still be a chance it would show up after that amount of time. So if I had said no, and I got checked then I just lied and got caught.
 
It's automatic road side suspension.

Drinking and driving gets an automatic suspension, truck impound and a military charge??? :shock:

Am I missing something here?

It says that as of Aug 2010 hybrid drivers i.e. GM2 will be held to the points penalties that affect novice drivers.

Does that not also include no alcohol?


O.k. looks like I'm as confused as the MP. Which means they could take you in and charge you and then drop the charges later, when they get them law clarified.

Needless to say that while I had my GM2, I would not have a drink the night before a ride, as it is 0% alcohol. I'm not sure how long it takes to get ALL alcohol out of your system, so I didn't mess around.

p.s. They really drove the no alcohol part home in the Humber motorcycle classes, did you not hear it at yours?

The alcohol part I don't believe applies to the hybrid part, just the points.

How if you get caught with booze on your m2 (riding) it's an instant road side suspension & impoundment + what ever other penalties would apply. The fact that 0% booze is a condition of the m1/m2/g1/g2 you will be looking at another suspension following regardless if you had blown over the .05 or .08 marks.

You've said that you don't believe it appiles.
But then its confusing that some of the law(s) apply to hybrid licenses, but others might not.

Is this something that is open to roadside interpretation then?
