Extortion by shop? Breach of privacy by cop?

I understand what you're saying but in the context of this story and what was reported, in my opinion there is still no criminal offense. Perhaps I was too general in my writing but my opinion still stands.

Maybe its because of the responses I get, I am also doing it for free.

if you think it through. its a silly requirement to have to identify the exact threat before it becomes criminal. ( thats actualy the test to break solicitor client privilege, there is a big difference )

it is not difficult to threaten someone without telling them exactly what is going to happen.

scroll up and read again the part I actually quoted. Rob understands what I am saying.

As stated above, I don't know whether the particular action is criminal from the presented facts.

my comment was not on your opinion of the situation. What i stated was false is this "If they didn't mention any particular criminal action then they haven't crossed the criminal line..."

The point is that the mentioning of a "particular criminal action" is not required.

I did not want the OP to read that and think he shouldn't call the cops, thats all. Only the OP's friend is in a position to determine whether the threat is credible or not. If he did get threatened, and didn't call the cops because he read your post and they only said "watch your back", and later is injured, would you be able to live with that? I take all my advice seriously, even if its just one word.

I am also against the general idea held by some on this board that you need proper evidence before calling the cops.

Maybe you see what I post as "short", but that is necessity. there is an awful awful amount of misinformation that gets floated around these forums day by day and I can't be writing essays on them all. I just try to post enough so people don't leave here with something in their heads thats gonna get them in trouble. Plus its not like I am appreciated anyway.

On this point I am in total agreement. There's many other reasons to call police, not just to get someone charged and if, as I mentioned, someone FEELS threatened then there's no better reason to call.

OP.... all i can say is no “legit” bike shop would allow your friend to take a bike out without having a copy of his license on file plus NO shop would say "sure take it for a rip around the block with no helmet" ........i think we are missing parts to the puzzle? Maybe his hand full of throttle was more then the 125 cc bike he was accustomed to ..maybe...

Which is where I also have a problem, as mentioned in my initial post... the entire story is, in my opinion, not too believable.

This is my version of the events and there is another side to this story. I have stated the shop specializes in Ducati's and is located in the west end of Toronto, just off the 427. Many members on this board go there and I'm confident they will hear about this thread.

For what it's worth, this thread has become far too technical, my post is not a sworn affidavit so please stop wasting time proof reading for grammatical errors. I achieved my goal when I started this thread, I got the general consensus on the situation and advised my friend to lawyer up.

I was simply asking for your opinions on the situation, not whether you believe me or not, that is irrelevant.

Thanks to those who gave helpful/useful comments.
