I just like how the Italians immediately jump in and charge people without really any solid idea of what happened or why.. You're assumed guilty and have to prove your innocence..

Indeed. How long did that drag out for? I think they charged a half-dozen people with manslaughter in that one..mandatory 10-18 year sentences..wow. Boni was the same with that slash to the chest. And yet somehow Berlusconi evades all of his charges. It's a weird place..

Exactly. I mean, these are serious consequences. It's coming out now that the cruise ship line authorized almost exactly the same fly-by on the island as this captain did 6 months ago. So perhaps they're trying to cover up a bit..

Oh, absolutely. But it's not so cut and dried now..the press was quoting people saying "the ships never come within less than 2 or 3 km's from the island.." and the cruise company was saying something similar. Turns out they've authorized it in the past, just not this time. Bottom line, he hit a rock.. Obviously there's a big mistake here..but if it turns out the rock was not on the chart, is he still worthy of a manslaughter charge and all that process that they've initiated? Media circus..

Yes. Also, time of day too, if the tide is in or out.

Goodness knows..they'll do a proper investigation and figure out what actually happened..pilot error..bad charts..bad instrumentation..I wish they'd not convict him in the media and by the police before due process. I think there's a thread on SOPA in a similar vein..
 
Comogli Carte Nautiche shows the rocks he hit (that's the charts), its the Italian version of NOAA, They have Simrad electronic chartplotters running, so theres no doubt where they were. At least 3 systems would have to have been overridden to get to where they were.

With a draft of 28ft , tide in or out wouldn't matter, they were hitting that rock.

Tripping and falling out of the Cruiser and landing in a lifeboat story?
After an abandon ship was declared, the coast guard commander in Livorno takes charge, Cruiser Captain was given a direct order, its in the published transcripts of the conversations, to reboard the cruiser and assist, get up the pilot ladder and reboard, return to his vessel and report how many passengers are left. He declined to re board the vessel and assist. THATS the abandon ship charge. Its 12 yrs in Italy.

The request for a course charge would have been sent through livornio and or Checeveccia (sp?) Coast Guard offices, they got no request. The "fly by" may have been done by others and approved by the cruise line, but this guy was on his own and got it very wrong. And people died.
 
I was sarcastic when I mentioned the "fall". But point taken about the drag and systems that would have alerted the crew to alter course.

Yeah, that trip into the lifeboat story is hilarious! Yeah...I tripped! That's what happened!! :-) haha! Oh, I have no doubt this guy is going down, I just object to the trial by media and information leaks..

Dont worry , i got the sarcasm :) , ship is 800' + long and he lands in a life boat.... Most of the other jumpers landed in the water, must have had special ninja training.
