Condo giving my bike the boot

The 'using the space as storage' is exactly what they're trying to get rid of. They've made it clear that they are blanket banning everything from the parking spaces that exceeds a single vehicle being parked. I managed to get in contact with someone on the board finally, and they were helpful with their description at least, but basically there is no hope for me until an AGM where a majority vote could change the by-law. I pleaded my case, and my landlord also finds it ridiculous what they're doing, but no victory. As for a lawsuit, they're already suing one tenant for the same reason because he has been less than co-operative apparently. I dont need to deal with that right now so I'll suck it up and move the bike.
I'm going to have to store it at a friends place for now and decide whether to sell it or not.

What I actually would have done is to write a letter on firm letterhead to the condo board explaining why you can't interpret it that way.

BAM! There you have it. Obviously this other ****** triggered the board to act and now they have to appear to apply the rules uniformly, so you get stung. That screws any chance you might have had to fight it.
 
So this makes me think....

Say I lived in your building there Twoth, and it was me and the wife, girlfriend, roommate, whatever, 2 of us, and neither had a car, but both rode bikes, I wonder how that would then work ? Ask them that, and see what the response is....

What if it was my wife, and 2 sons and no car but 4 bikes ? Are they going to tell me I can only park one bike in the parking spot designated for my use.

I would be looking at talking to a lawyer, there are many that are free of charge on a one time question, also maybe get a hold of someone at the http://www.ltb.gov.on.ca/en/index.htm

Yes, they'd say just one bike. Lawyer wouldn't waste more than 2 minutes on your case.

Maybe not but the Landlord and Tenant Board would

I just got off the phone with them, and they have had cases like this, and have overturned the Condo's so called By-Laws,

Twoth - go to the site, get the application T2, and send it off, see what happens, or give the LTB a call and talk to them directly yourself, I just got off the phone with a very informative person, who more or less told me their rules supercede the buildings rules, and you just might be able to keep your car and bike on the one spot.

The Condo is infringing on his right to the type of vehicle he is allowed to have on that parking spot, and that is not acceptable, they can't dictate to him in that manner, they also cannot dictate the number of vehicles,,,well they can but the LTB does not have that stipulation (a number associated to how many vehicles in a parking spot, only that you can yuse a parking spot if assigned one or paying for one etc...), so they can possibly supercede with their rule over the Condo's rule....Like I said if it was me and my wife and 2 bikes, and we use transit in the winter but bike in the summer, how can they tell me I can only have one bike.........

it's not a way to have derelict cars or bikes or boats or crap in your spot, but something that is being used, is licensed, insured etc, there really should be no problem....
 
GateKeeper, I think OP is trying to find an acceptable solution, which satisfies him and his condo board, not stir **** in the pot and try to win the losing battle. Who in their right mind would want to spend their time and money fighting a bunch of people who have nothing better to do, but to fight with you? I've had my fair "share" of condo laws when we lived in a condo for three years. Just bought a house and couldn't be happier when I moved out of that upscale condo, which has more laws than a prison.

Well if the OP, can't find the time to fill out the form, submit it and let the LTB do it's job and see if his concerns have any merit, well, then he should just pack up and move, or sell his bike. This is not stiring chit, it's not allowing someone to trample all over your rights, plain and simple.

I lived in a condo as well, was even on the board, and had a few bylaws changed that I thought were wrong, happy tenants make for a happy condo.

It's very similar to the condo laws that used to be around that you couldn't have a pet, well that got thrown out, not in some condos, but all condo's, you cannot tell someone they cannot have a pet, read that as a "companion"

Condo's can throw up all kinds of law's they want, don't mean they can't be fought against and removed or amended.....

I don't think going through the LTB, costs anything, but I cannot confirm this, I have not looked to see if they have a fee schedule....

So why not do something, that could not only benefit the OP, but the rest of the tenants....

By the way, just because your in a house does not mean you don't have rules to follow......just try and make your fence higher, or widen your driveway, or cut down a tree, or not shovel your sidewalk(if applicable) or park on the boulevard(if applicable) and the list goes on.......I put a hot tub in my back yard, not only did I have by-law officers at my house but I also had the police there as well, friggen neighbours, but that is another story......

I will give that company a call, thank's for looking into it. If it ends up costing me anything I really won't end up doing anything about it since I'm renting. I will just move if this becomes a major problem. I'm moving my bike to a friends place for now until we figure this out.
As for those mentioning 2 people in 1 parking spot, I brought that up and they dont care. They also didn't care to hear my argument on how there is not anywhere near enough parking for this condo and if I had only a bike in my spot it would most likely piss off other tenants looking for a spot to put their car.

Anyway, I'll look into that link, but I feel the battle has been lost. They're not having any of my letters and phone calls. This rule is common in condos, but it's up to the board to enforce it.
 
Look around for another place in your garage that is too small for a car, but big enough for your bike and negotiate a reasonable rent for the space.

At the end of the day, the residents vote for who's on the board

So you should have befriended atleast one member if not more, when the board goes door to door begging for votes

All the buildings i've worked at, they don't care about bikes

more concerned about boxes and fire hazards which push fire premiums upon random inspections

OP IIRC isn't an owner so getting on the board is difficult.

A lot of people don't want to be on the board so begging is not always needed.

I see a lot of bikes in undergrounds but all it takes is a few self righteous world fixers to make life miserable. Cars outnumber bikes 50 to 1? On the road or in the garage who's going to win?
 
Man, just sell of your condo and find a better place, where ppl are more friendly to our two-wheel friends:D

I was going to say, just move. I wouldn't live somewhere that annoying.
 
Wow... I didnt realize living in a condo comes with so much BS. Another reason to live further north lol!
 
You must live in Park Lake on Lake Shore, cause we are going through the exact same thing here now. Nowhere does it say more then one motor vehicle is allowed. It only states Motor Vehicle parking purposes only. And the board is not being easy to deal with at all. Thank god the AGM is coming up.

What if we are owners of the condo? Would this place still be able to assist?

EDIT: they deal with renters and landlords only.

give them a call, perhaps they have someone else that can assist you, the lady I spoke with was very helpful and really knew her stuff, the call can't hurt.

then again as an owner, go to the AGM, and have the By-Law changed, or amended, or pass a new By-Law, rally fellow owners to help you out and vote with you.
