If the damage was considerable, I would tell him the cost to replace the bike and helmet.

Explain to him the seasonal queue to which you have to contend with. Essentially, your ability to ride this season is over.

Compound the severity; express compassion and say "I think it would be best for both of us to..*Pause for a breath* go through insurance".

If he can cover it, he will. Otherwise, call the insurance asap.

Yes, accidents happen. In this case, you should not be the one inconvenienced in any way.

If he pays you out. Buy a new bike of your choice within budget
If once given that valid choice he opts for insurance; you've done your bit. Make the call asap

I would not wait much longer.

Again. Accidents happen. The guy that hit your bike may have 3 kids and a wife he's recently brought over to Canada. For a better opportunity.
Although he could be an ***, he's very likely very tired and sore and stressed.
When he hit your bike he knew he was in the wrong and owned up to it.

Give him a chance.

We've all made mistakes and wished the other person would let us make it right.

I would go through insurance, report as an accident at reporting center. SO many times after an accident, the initial feelings of remorse turn to evade, and they make it a royal pan to get compensated. F# them F# their driving record F# their insurance F# their job.

Tell him since you don't want to loose riding time show him the cost of a bike the same age on kijiji.. i know there isnt to many VTR's out there these days..

Says its $2000 tell him you want the 2000 cash to buy get a new bike. He can then take the wreck if he wants and he cant sell that to re-coop the costs (or you keep it and part swap). But you need to set a date for cash and make it soon. If he is hesitant go through insurance..
 
Report and through insurance. Don't give him the benefit of the doubt. He wont be able to afford the cash to pay for repairs anyway, probably 3K in damage.

There is no way he's going to pay anything close to 2 grand. The guy saw an old bike and figured there couldn't be more than a couple hundred bucks in damage. Don't waste your time with his empty promise.
 
As an insurance advisor. I would report this incident right away. Last thing you want is going through the hassle chasing after him, he may become evasive. Keep in mind your not at fault this will not impact you anyway, you don't have to pay any deductible and you will be covered under DC PD.
 
Report and go through insurance. He hit your bike, he has to deal with the consequences. This shouldn't inconvenience you in any way/shape or form. If you work with him, what do you get? Nothing. No benefit at all for you.

Give him a chance, at least he stuck around... but get it done today - don't wait, if he doesn't want to pay get that claim filed.
 
I remember when I was in my car on the DVP a few years back & it was a stand still...I was fully stopped & happened to look at my rear view mirror when I seen an older Mercedes coming up fast on me, then I heard tires screeching so I braced myself, just about when the other car was about to hit me I gave it a little gas to soften the impact...well I did receive some damage...my bumper got a crack & some paint scuffs!

The driver of the Mercedes was an Asian dude...he seemed pretty cool & sorry about hitting my car & offered to pay the repair bill instead of going through insurance, so I got all of his info, number, plate...etc!

I got the estimate by the end of the day after and it was $1200.00...I tried to call him several times but to no success I couldn't reach him, I figured that I would give him the benefit of doubt by paying out of pocket so that way it wouldn't affect his policy & I was wrong, so I scooted over to the collision reporting centre and filed a claim, I talked to a cop over there & explained what happened then they took a look at all the info that I had on him...it appeared that he did not have any insurance at all but I did get my car fixed under the no fault!

Goes to show you that you may be a nice guy & give someone a break but in the end they will **** you around & try to get away without any responsibility!

Go to the reporting centre by the end of the day if he hasn't agreed to pay you the damages or if he's trying to low ball...no headaches!

I tried being nice once when someone dented my car fender. He asked to pay and I said OK, just let me get the insurance just in case.
I asked for the other guy to hold on a sec while I got my docs from the glovebox.
At that point I heard his engine start and he sped off so fast, I couldn't even get the plate.
Never again!
 
I'm going through this right now as a result of being hit from behind in my car on the 401. Other driver didn't want to go through insurance. Okay ... I'll take the car to where I want to have it repaired, you give them your credit card number, have them bill that more than the foreseeable amount that the repair could cost *up front*, we get the car fixed and reimburse whatever wasn't spent. He didn't want that ... wanted a written estimate. Shop ... Doesn't work that way, we have to remove panels to inspect for hidden damage.

I could see where this was going. He'd get that estimate and then cry poor, by which time it's too late to go through the regular procedure.

Off to the collision reporting center and insurance agent we go.

If he had given the shop a blank check up front to fix the car, I would have played along. But anything short of that, anything resembling difficulty or nuisance or headache on my part, or any risk of non-payment ... go through insurance.

I'd give him a chance, but keep a short leash.

He has *much* more motivation than a normal person to keep it off the record, and could very well be willing to put down a couple grand.

If he says one word towards bargaining with you, tell him you have no problem reporting it.

Cabbie is not happy about the bill, he still wants to pay, he is squirming about the amount, said " well I have to do what I have to do"

be ready to pay more than that quote.. you might end up being out at few hundred you wont be able to go back to him for that..
 
I was in a minor fender bender once during the winter. The guy said not to report it he'd pay. I was tired and depressed so I didn't file a claim though I did end up reporting it anyway to collision. Not sure what if anything happened with him because of the report. The car was old and whatever. However, if it was straight up insurance I would have gotten the repairs done which never did get done.

The point of this story is that even if you report it but agree not to file a claim, _you_ are responsible to collect the money. How do you propose to collect from someone via what method over how much time?

It becomes a project. "Collect money from someone."

Too much trouble.
