Banned from driving for life but......

An Ontario judge was moved to tears while delivering a life prison sentence

I don't believe it's very professional of judges to have emotional investments in the cases over which they preside.
 
To bad some one had to die before the jerkwad got put away.
Now if only they would do this to all the repeat drunk drivers out there.

Try to use your imagination enough to factor in how many near misses/partial hits happened before he finally killed someone.

do you work for the media? "minor conviction" never said anything about minor accidents. The question should be asked why did it take 150 convictions to finally give him a major conviction.

Maybe one of our legals can comment but I assume traffic violations and criminal violations are kept in different folders. At some point a bad driver should have a court order to not drive. Then if he drives it becomes a criminal offence. Right or wrong? Would he care?

One of Smith's skanky friends was on the news saying he has a drug problem and needs help not prison. I am sympathetic to people that are trying to overcome problems but at some time the head geniouses are going to have to admit they aren't smart enough to fix stupid. Spend the time and money on those with promise of rehab.

Yea, all life sentences for those who got charged with enough evidence to prove their guilty r a waste of resource, especially for rapists and serial killers... such as that Barnard guy!

They should send him to the Black Dolphine prison in Russia.

Executing a person in any sufficiently humane legal system costs more than keeping them behind bars for life. If you think the way they do it in Russia or China is the way to go you should live there.

- Capital punishment is not cheaper.
- Death penalty is not a deterrent. It never was.
- You cannot rehabilitate an executed person if he/she is eventually proven innocent.
- There is no way to insure an innocent person will never be convicted.
- Someone has to pull the trigger, flip the switch, etc. That person is a legally sanctioned murderer.

What other arguments for capital punishment are there? Whatever you can come up with, rest assured it's already been thoroughly refuted. Death penalty belongs in middle ages, period.

If you think lifers got it easy just check what a life in a Supermax prison looks like. I would rather let them execute me twice than spend the rest of my life like that.

It is barbaric. The fact that some US states still practice it is not an argument against it's barbaric nature but an argument for declaring those state's penal systems as barbaric.

Speaking of states, the statistics in those that had abolished and re-instated the death penalty pretty much completely refute one of the "strongest" pro arguments - the so called deterrent factor.

Innocent people get convicted fairly regularly in any system, but they get executed only where there is a death penalty. Remember Romeo Phillion, the fellow that was released after spending 32 years in prison for a murder he did not commit? How would you exonerate/rehabilitate/compensate him if he was executed?

Just to let you know, I am fully aware of innocent ppl who have been convicted. I believe that people who were doing such heinous crimes and were witnessed by many, should face the death penalty. Guys like the Norwegian Kill, should face the firing squad

It costs more to execute due to the legal process, not due to a $1 bullet or a $50 chemical injection.

On the other hand, labor camps PRODUCE value, hmm... something to think about.

I didn't mention Russia, kickstartt did. You are not following the discussion and you are arguing with points I didn't make.

I believe that people who were doing such heinous crimes and were witnessed by many, should face the death penalty.

I believe that no system can or should be trusted not to convict an innocent man. Least of all the system that relies on witnesses more than it does on material evidence.

I doubt a single one of his victims or their families would agree with you. Norway probably has the most advanced and humane penal system in the world - the one that focuses on rehabilitation, not punishment/retaliation. It's very effective too - their recidivism rate is lower than any other country, AFAIK. I can't predict what Anders Behring Breivik's conviction will ultimately be, but I'm glad it won't be capital punishment. It wouldn't help anyone, not even his victim's families.

Wasn't the key suspect in the Jessop murder almost found guilty because the police coersed the witnesses to change some time observations. Let's fix the whole system.

Also when David Milgaard was finally acquited the police had the real killer in custody in a day or two. Coincidence?

I might kill someone who did to my loved ones something like what Paul Bernardo did. That wouldn't make me less of a murderer and certainly wouldn't justify killing him in my name instead.

I have no generosity for them. I just fundamentally disagree with making someone else a murderer or risking to kill innocent people just to get even.

I bet you my yearly salary that every one of those cases where people were taken off death row due to DNA evidence provoked the same reactions at the time. Where are the fine folks that offered to pull the trigger or stick the needle in those people now?
