Is he going to worry if he has a licence when he stole the car.

An Ontario judge was moved to tears while delivering a life prison sentence to a serial carjacker who killed a woman and injured five others after driving a stolen van into her car during a 2010 police chase.

Robert Clifford Smith, 43, was behind the wheel of the stolen Dodge Caravan that T-boned 26-year-old Sarah Attayee's Honda on Valentine's Day in 2010. The province's Special Investigations Unit said Smith, who at the time had racked up more than 150 convictions across six Toronto police divisions, ran a red light as police cruisers tailed him in Scarborough.

Attayee died later in hospital. Five other female passengers in her Honda were hurt.

Smith, who was found guilty of criminal negligence causing death and bodily harm, will not be eligible to apply for parole for 10 years.

Ontario Superior Court Justice Jane Kelly stopped to wipe tears from eyes several times during her remarks to the Toronto courtrooom at the Friday sentencing.

"Mr. Smith, you are totally to blame," she said. "You are a serious and uncontrollable criminal."

Applause broke out from the courtroom when she delivered the sentence. Smith has also been banned from driving anywhere in Canada for life.

"He no longer deserves the privilege of sharing the road with the public and must be separated from the rest of the family," said Justice Kelly.

A life sentence is rare for the charges Smith was convicted of. But police had said Smith's numerous prior convictions make him a dangerous career criminal.

Justice Kelly agreed, saying his "rehabilitation prospects are dim if not nonexistent."

The SIU investigated the circumstances of the chase leading up to the crash and concluded in May 2010 that police did nothing wrong.

The van Smith was driving was reportedly speeding at 100 km/h upon impact. Officers spotted the van and pursued it because it matched the description of a vehicle near the scene of a break-in that evening.

SIU director Ian Scott said in a news release that "in hindsight it may have been preferable to have called the pursuit off due to Mr. Smith's reckless driving," but that he nevertheless felt the officer giving chase "did at the time attempt to balance the public safety interests with the need to apprehend Mr. Smith."
 
A life sentence rarely means the rest of your life in prison. He's eligible for parole in 10 years and if he's a model prisoner, will probably be released.

LIFE sentence? Damn that's harsh even despite the eligibility for parole in 10 years.
 
nobbie48, that's also the first thing i thought when i heard the sentence and the conditions.

this guy clearly had no respect for the law by consistently breaking societal norms.

if given the chance to get behind the wheel again, i doubt very much that he's going to bother making sure his license, registration and insurance are in good order.

even with that, i don't know if he deserves a life sentence. . .in his present condition, probably. he needs some help, because currently he seems to be a high likelihood to re-offend. maybe he'll get that help in prison.

if only they could invent some sort of ankle-monitoring device that additionally acts as like an all-vehicle immobilizer (hard to do when you have classic cars out there older than 20 years, i know). if only.
 
life sentence is 25 years i thought

There is commonly life-10 and life-25

the numbers being the earliest parole eligibility. for example 1st degree murder is always life-25

Far too many soft attitudes around here..what kind of message should we sending with punishments of such incorrigible repeat offending crimes? You really think coddling with acceptance, forgiveness and leniency will rehabilitate?? Get a ****ing grip those of you whose ears are burning..
Thank goodness enough conclusive evidence was available to enable that judge to at least hand down what she did..too bad about the tears though.

just kill him!!! it will be a waste of money to keep him in jail
 
First degree murder: life, parole eligibility 25 years
Second degree murder: life, parole eligibility 10 years

Smith received a sentence equal to second degree murder for a conviction of criminal negligence causing death.
 
memo to self if you rack up 150 minor convictions make sure not to accidentally kill someone.

I just thought it was a bit weird funny. Kinda like taking away the TV and banning the remote as well.

If paroled in 10 years he will either have been reformed and no danger on the road or not reformed and will drive without a licence. That part of the sentence is just garnish.
 
Sentence deserved, but there are lots of white collar criminals who should get the same treatment instead of a deal and a slap on the wrist. He killed one person and destroyed one family, but these guys kill thousands and destroy tens of thousands of families.

He was a car-jacker and a thief! 150 times!!

Try to use your imagination enough to factor in how many near misses/partial hits happened before he finally killed someone.

Doesn't sound minor to me.
