I think it's funny how people, who didn't follow the case and don't understand the precedent, think that the case was frivolous on its face. This was far from the first time that this sort of thing happened, where McDonalds was concerned, and the jury considered them to have been on notice. That figured into the judgment.


The coffee one in my eyes wasn't actually frivolous once you know the facts, the one about losing the pants tho, thats a whole different ballpark.

I don't consider it to be all the frivolous when a company is effectively put on notice repeatedly through lawsuits and settlements, that they are putting people in danger, and continues to do just as they've done before. This wasn't the first case, by a long shot, and it isn't likely to be the last.

The problem is that people rarely look past a spin and a headline.
 
It's funny the way people say 5 million for a coffee on the lap, but most people don't realise the amount of damage that lady suffered on her lap and legs, I think 5 million wasn't enough



From what I was able to find the case was settled confidentially out of court for, possibly, around ten cents on the dollar. I don't know what percentage went to the lawyer. The case wasn't as simple as: Spill coffee, collect $5 million.

All that I've seen is pure speculation, as to it being "something less than $600,000.00." As the judge had finally decided on a total figure of $640,000.00, in the original lawsuit, I find that rather hard to believe and speculation is worth exactly nothing. The actual settlement was not publicized.
 
Bradsma, DO NOT talk to anyone on this forum about your accident or the way your going with it.

go get an assessment from a doctor. then make your decision. IMO

I'm not asking for details. They're not necessary to help him. All I gave him was how to report injuries to his insurance company, the necessary forms to start the ball rolling. I can advise him of the benefits available to him under his auto policy all without a single detail about the car accident.

I don't see how an accessment from a doctor is going to apprise him of his rights under his insurance policy.
 
Spoke with my insurance company on both the auto and benifits side of things and the ball is rolling on both.

It won't, but he will then have documentation to support wage replacement, if necessary. Without it he's just another Whiplash Willie.

Claims have a lot more weight to them when the family doctor is on board with the clients injuries. However in order to save time and money our mystery guest could have brought an OCF-3 disability certificate with him to be completed by his family doctor. This document would advise the insurance company how long they (the doc) think the client should be off work.
 
The best advice that I can give you is don't listen to most of the advice you're being given in this thread. Your insurance company is there to help you, not to screw you over. Your adjuster is the expert when it comes to what you are and are not covered and after reading thru this thread you've got some less than accurate info.

There is a 7 day deductible for income replacement and if your current limit is not high enough I would suggest that you call your broker/agent and have it raised. You can't be upset about not having enough coverage if that's all you bought.

Thats the point, but the idea that going to a doctor is somehow a replacement for some of the decent advice previously given in the thread is wack. (thats what I got from the original post)
The 2 are not mutually exclusive.

There is often a lot of psudo legal paranoia on this forum about posting about experiences as some kind of complete bar to recovery or a non-guilty determination on this forum. When thats just ridiculous. Obviously if you are posting "I AM GONNA PRETEND TO BE INJURED MWHAHWAHHA" thats different but there has been nothing of the sort.

If you know your policy and what you're covered for you'll see that no insurance company is going to deliberately cheat you out of something. If you have an accident and miss 2 weeks of work and expect to get a million dollar settlement out of it than you're going to be dissapointed. But if you read you policy you'll see that you get exactly what is stated. No more and no less.

Whenever I call my agent to ask them about my policy, it feels like if I'm there to cheat them. They treat me like a criminal. I later found out my policy covers me for roadside towing. They pay 80% I think (can't remember the exact figure). For 8yrs I didn't know this until recently <<shakes head>>

Coupled with that, when someone hit me from the back, I called my agent and one of his secretaries were bold enough to tell me they can't do anything about it. Even though they finally did, I was really upset on what she had told me.

Needless to say, I am wondering if I can get another agent with Statefarm or if I really find a cheaper alternative, I'll be out.

However, I'm sure Abdadjuster might have good intentions.
