Well this time i got it on video.

Last night peel police chasing this guy they fly by me doing what the police said was 150km in a 80km. The SUV clips my leg as i was stoped at the red light the police call of the chase due to the speed then this dumb a@@ hits a stang running a 2nd red. I am at work right now so cant post the vid till i get home around 9 tonight. Also before you see the vid let me just say one thing i did see them coming up behind me but they were coming so fast i wasnt sure what way they would go around me so i tucked in and just hoped for the best. thank god he only cliped my leg not hard enough to knock me over just a brush by.

so here it is. seeing it again makes me see how close it was to me getting really hurt.

Did you not report that you also were clipped? No mention in the article of a rider hit? I would be making a statement "in case" any future issues, but also to add to this clowns potential charges. it states he was impaired driving and needs as much thrown at him as possible

trailing cop stopped and took all my info when i post the vid later you will see. if you read what it say hes changed with failure ti remain thats because he hit me.

**** your really lucky, Glad to hear you are okay. I would take this a step further and try to taking legal action on this SOB. Cant wait to see the footage !

Isn't the SIU supposed to get involved when a civilian gets injured due to police involvement?

Failure to remain only applies when you hit something and deliberately drive off. From the description it didn't seem like he even noticed he had hit you. "Dangerous driving" would seem more appropriate in this case.
 
Do you record all your rides? or just happen to be recording today?
starting to seem like a small cam would be a darn good idea....

I record all my rides. Also sorry i thought thats what the failure was for my bad when the office called me back this morning he said that the guy had no clue he had brushed me when he went by.
 
Still not understanding why he would not be charged with fail to remain even if he hadn't noticed he hit you... if he had killed you he wouldn't be charged for that cause he didn't notice?

So all one has to say is "I didnt know I hit anything" and their off the hook....Dont think it works like that, failure to remain is failure to remain...

If it is reasonably possible that you indeed may have not noticed, then yes. Most collisions aren't that way, though. They produce large dents, happen in ways that jerk the vehicle or make it stop, etc. Things that are hard to miss. You are not going to convince anyone that you didn't notice a collision that took out half of your front bumper.

How are you supposed to stop if you don't notice that you hit something?

That being said...I don't know how you don't notice you hit something or worse...someone.
 
well really when you see the vid you cant even tell i was hit it was just a light brush by but he still did bump me. i dont know how the failure would work and not gunna try and get it. :p

Drunk people dont notice much either lol, so I think failure to remain would still be layed reguardless of what he says after the fact...Along with alot of other charges...Either way I doubt they would leave out failure to remain just because a drunk guy running from the police says "I didnt know I hit anyone"....

If you have some experience with traffic police, youd know that they lay as many charges as possbile. In hopes that at least one sticks....The guy could be laid up in a hospital bed, and as soon as he opens his eyes get slapped with 10 different charges before he even has a chance to explain himself....That chance will only come in court

The Criminal Code offence of fail to remain still requires mens rea to convict, so the Crown would have to prove that the accused either knew or reasonably ought to have know that there had been a collision. In this particular one, it's not like there was a big or even small "thud-like" crash with the rider that would make it obvious there had been contact.

If the rider was just lightly brushed and not knocked over or sent flying, then there would be virtually no noticeably impact felt by the driver of the car. The driver of the car just needs to maintain that he did not know there was a collision, that he felt no impact, that he though there was enough room to squeeze by without contact, then there is not much to prove any mens rea, and in turn it will be more difficult to convict for fail to remain.

A dangerous driving charge would probably have been much easier to support, but the cops can still come back and add that charge to the roster later.
