I was not able to use my girlfriend as a witness油井緋色;1875189 said:Just wondering cause today a jackass nearly rammed into my gf (we both ride).
I know passengers cannot be witnesses, what other "cannots" are there?

When the judge excluded my "witness" he said it CAN be someone you know, just not someone that loves you (brother, sister, girlfriend, etc.).油井緋色;1877411 said:So a witness cannot be someone you know correct?
I saw a buddy get hit once, they let me be a witness. Wasn't even a problem.

As coyo said, if you know the witness, less credibility might be given.

So if I see a jackass do a left turn and my gf tbones them or hits them and I tell them I saw the accident I get screwed even tho we're operating different vehicles?

Would you lie to protect your girlfriend, or betray her by telling the truth?
Either way you'd be in deep!
Wife is fine then right?
Any person can be a witness, the issue comes down to establishing credibility. If your girlfriend was a police officer, firefighter, lawyer, paralegal, doctor, Canadian Forces member, or any other position which exudes reliability or credibility, there is no reason they cannot be a credible witness. How this is established is at the start of your line of questioning - establishing that credible position in society, so that what they say cannot be questioned later as truthful or not.
Moreso, having a very straight line of questioning, with no loopholes or answers which might create doubt in the various witnesses is also very helpful.
True, but bringing this back down to an HTA matter, without a serious matter at hand, I don't think that those titles would matter much. Criminal matters would change things.
Lets be clear, when you are talking about insurance fault determination, they have witness rules, in court, those rules are different. what are we talking about here?
