Truck reverse parked over my bike. Wait for cash or go through insurance?!?

When someone does something this stupid I always go through insurance. Simple reason is they need to learn a lesson and not going through insurance just increases your (my) risk of not getting all the money.

The only time I give anyone a break anymore is if it was a total fluke accident and I have basically no damage. Any truck or SUV is pretty much an automatic insurance claim because they always do big damage.

Im with this mentality as well. If the person is clearly an idiot and not just a regular average joe who had a brief lapse in judgement, they need to understand the consequence of their actions to the fullest degree.
 
In the end its no fault with insurance companies. Your insurance will pay your damages and her company will pay hers. Your rates go up because of her fk up come renewal time. Take the cash or threaten to take her to court for on going insurance premiums. Not to mention your insruance company may not pay out for the helmets or your CB exhaust unless you added that in your contract. Oh and the deductable of course . . . Dont trag it on get her to pay it off ASAP.

According to the Ontario FDR's, which in this case actually follow common sense, fault is 100% hers and 0% yours, so this will not affect your insurance. A least, go to a collision reporting center and report it. There is a clause or something that allows you not to report it to the insurance industry, but you can change your mind if she hesitates on paying for even a second.

I was caging it a couple of years back and go sideswiped by a lady who thought that 2 objects can occupy the same space at the same time. As she found out, that wasn't the case. At first she was apologetic and begged me not to go through insurance. I reported the collision at a reporting center, but with that stipulation not to report it to the insurance. I got a very reasonable quote from a reputable body shop that is used by the insurance industry for just under $1000 (major damage to the driver side door, quarter-fender, bumper and headlight on a relatively new car). When I told her, she asked me "Do I have to pay all of it? I signaled!" That's when I called the collision reporting center and instructed them to report the collision to the insurance company. Then I called the insurance company immediately an explained the situation. Because the lady started making up some b.s. story about me running into her, I was hounding the adjuster regularly until the case got closed (0% liability on my part). Moral of this story: REPORT IT TO THE POLICE!!! You can do so without involving the insurance industry.

P.S. The owner of the vehicle that I was driving was with me at the time and it was their decision to try a cash settlement. I probably would have gone for it, had it been my car, but now, I'd be having 2nd thoughts.
 
No matter what call the police now and make a report, this way if she tries to **** you over you have a back up. Trust me.

And in my experience if you don't get a bag cash within 24 hrs, go to the insurance company. You are only helping her by not going to the insurance companies. So since she ****ed your bike up, why help her?

After doing several cash deals over the years, I would never do it again, unless the accident was my fault.

You could not be any further from the truth. Eventually all your damages will be recovered either from the other party's insurance company or from the uninsured/underinsured fund set up to pay for accidents involving, you guessed it, uninsured motorists. But this process takes time, which is why initially your insurance company covers your damages.

Your insurance rates will also NOT go up if you are deemed 100% not at fault. The only way I can see a 100% not at fault accident counting against you is if you have several other tickets and accidents on your record. The insurance companies may be a lot of things, but they are not stupid. So if you have a conviction record 10 pages long, and I have seen one like that in person, they will realize that you are simply too dangerous to cover and will bump your rates just to make you go away.

To the OP, report the accident ASAP. It will not show in your insurance records, but wait too long and it will count against you when/if you eventually make a claim. From the amount of damage to your bike, I seriously doubt the driver will want to pay out of pocket.
 
Don't be dumb. go thru insurance. She can still file after she pays you some cash.... to get her paint fixed and down the road its your fault lol....

If you do anything else, get it in writing. Lawyers love stuff like this....
 
I had a similar situation where someone tried to share my lane with me. They asked not to go through insuarnce etc etc (cops were called to the scene so I didnt ave to report it to them) I gave them 24hrs to get back to me with the cash, they didn't (they were 100% at fault got charged with an unsafe lane change) so I went through the insurance company who wrote the bike off (sub frame was bent).

At the very least file the accident report so you can always make the claim if they dont pay up.
 
That's why new cars have 57 cameras on the rear of the vehicle now, so women can park without ramming into huge, brightly colored objects. :rolleyes:

I swear this is the tenth time i've heard a guy say some woman blindly ran over their motorcycle, including one of my friends wives, who plowed his Harley right off the driveway into the road and didn't even notice.... :banghead:
 
lol seriously, a knocked bike costs $2,000? So that means I would probably walked away from one if I'm the one that knocks one over.

easily. Fairings on some bikes are about $600-800 per PANEL and thats before the decals. Mirrors 200 each. Pegs/shifters $200-$300.. then there's the labour cost too.

Edit: Hmm... Reading a couple of posts up, I was not aware you can report accidents over the phone.

I can hear the conversation now, when she came into the house; "Honey, could you check the car? The brakes seem to be dragging."
 
this is exactly why I don't park across the back of a spot. I always pull up to the front of the spot, right in the middle. I don't care if someone thinks I shouldn't be taking up a whole parking spot or not, at least I don't have to worry about cagers trying to share a spot with me.

why? I would like the police to take note of who was at fault etc. Ofcourse I would have taken photos too, but I want to have a police record of this at the scene. I know parking lots are another story, but I'm talking about streetside accidents

I never even knew it was common practice to park across the back because I always thought it would only increase my chances of having my bike knocked over or worse. I always park like you do for the very same reason.

They're meant for minor collisions with damages estimated to be under $1000. If your collision is estimated to cost over $1000 for one or both vehicles combined, then you should call the Police. As for fault, in this case it wouldn't be hard to tell what happened.

Ok, this thread seems to be the best place to ask this.

I was driving home with the GF in my cage on Saturday, northbound on the 410, in the left lane. A car in front of me is doing 110. I hate riding the left lane when there is no clear need to, so I wanted to get past and move back into the middle lane, but there was another car there. So I waited until the car in front of me passed that car, and gave him a few seconds to move out of the way. He doesn't. So I high beam him. At which point, he does signal a lane change, but then, for some reason, he hits his brakes. So obviously, I do the same. It wasn't too hard, I had more than enough room, and we didn't come to a complete stop or anything. Thinking back, I think there was someone in front of him with their taillights out and they got spooked because they didn't see them.

Then, all of a sudden, we feel a knock from behind. Turns out, there was a pickup/SUV behind us that was tailgating us too. I usually am vigilant about checking my rearview and keeping enough space in front, but I'll be honest, I lapsed this time. So we felt this knock, and my GF flips out because we got hit. Luckily, we weren't stopped, I had my foot pulled in on the clutch, and I wasn't slammed on the brakes, so it just rolled us forward a bit. Calmly, I signaled, and we pulled off on the shoulder.

Before I write what happened, my question is, what is the proper procedure for handling these situations? What information should I be getting? What should I be doing? How do I ensure that all parties are held accountable?

I stepped out, and we checked out the damage. It was just our bumpers knocking. I had light scuffs on my painted bumper, and his metal bumper was undamaged according to him. I confirmed that my GF and I were ok, and that he was too. I got his name, cell number (and called it, to make sure it was right), and his license plate. He started saying that I slammed on my brakes, and that I shouldn't have done that (almost making it seem like it's my fault). I wasn't argumentative, but I stated, that the people in front of me hit the brakes, and that I had more than enough room to stop. I said, these things happen, and thankfully, it looks like everything's ok. That I would contact him if anything changes.

We set off, and my GF starts freaking me out saying that we might feel whiplash in our neck the next morning. I was pretty shaken, just because I've never been in a multi-vehicle collision (except once on the track). I do my best to be a safe driver, and this whole thing made me evaluate what I did wrong. I know in the eyes of the law/insurance, it's not my fault, but still. Anyway, thankfully, the GF and I felt no pain the next day, and I haven't had to call the guy.
