Speeding ticket fight

Some people aren't tech savvy, if you wanted to be snarky you could have at least linked him the link using lmgtfy.com, which is snarky and amusing at the same time.

The OP found and has been on the forum since 2008 and figured out how to post 600+ messages. Me thinks he's tech savvy to google some of his questions.


But that site is great. Learned something new and have a new tool. Lol
 
Hey, Major! There's no problem for me to find info in i-net. Though the things from ppl with experience on this board gave me a lot of info, which corrects my understanding, of what am I doing...

It's a time to get back to that case. about a month left before the trail.

Here are the facts:
1. the offense date is early July 2011
2. original court date was set to August 15th, 2012 in Sydney, NS
3. in July 2012 the court date was shifted to November 19th, 2012 in Baddeck, NS

So, there's more than 16 month past. I want to file 11b. I found some referrals, that 11b was filed after 11 month in NS.

Now, the question:

What should I do to file 11b?

Should I contact first with prosecutor? Is there a special form to file 11b in NS?

I asked them to send me some additional information: Radar Manual.

I checked the website and:
1. they have Stalker DSR and Stalker DUAL models, but not an Stalker DUAL DSR solved
2. the pictures for both of them are slightly different from what I (and buddy of mine) did see in the officer's cruiser. solved
3. they miss-spell my name again. And now that's not funny anymore - they miss-spell last letter, even when in all requests I was sending to them, I was signing my name correctly!

* should I send an additional request to them, saying, that the radar display, that I saw was different from the one that is presented on the manufacturer website?
* should I notify them, that the radar model they provided does not exist?
* As I understand,my name spelling is one of my first questions at the court?
* Should I contact prosecutor to file 11b?
* As by now, I scheduled my off-days for the time of the court, so I plan to go to NS. Should I try to find paralegal anyways? What should I ask him/her to do? How does it work?
* can I use the "language" thing for my defense? I mean, the things I told to officer are wrong due to my bad english. It was a year and a half ago, and then, it was my first traffic stop - I did worry, and when I worry, my English becomes terrible. So I was saying the things which have been interpreted by officer incorrectly from that what I tried to say.

Just had a conversation with one of lawyers of North Sydney, NS. He gave me some pretty pessimistic advices.
He said:
1. there's no really paralegals or lawyers who gonna deal with speeding ticket;
2. he's price will count with XXXX dollars, so there's no reason to do it;
3. The RCMP officer Mark Skinner is the one who gonna "issue a ticket to his mother";
4. The trail periods have different timing there, so four month shift (16 month in compare with 13 month original trail date) will probably not be counted for 11b.
5. One letter mistake in the name will be considered as minor correction;
and some other advices, that
6. It might be good idea to contact Prosecutor;
7. Ask some friend to show up at the court;
8. Points from NS probably won't show up in ON.

Does anybody have an idea about inter-provincial tickets? How does it affect the Driving history? How does it affect local points system?

Well, he even suggested just to forget about that ticket in case I'm not driving in NS anymore, that I do not consider as an option.

I was speaking with prosecutor last Friday about a possibility of plea-bearing. He replied, that it is not possible. Then I asked for 11b - he said he gonna speak with the court about that option.
Next conversation last Monday: He said, that they decided to reduce the charge. I kinda accepted that.

Conclusion:
If you ever gonna be riding Cabot Trail or anywhere else in NS - be very careful with a speed or it gonna be pricey:binky:

If you're looking for 11b, then you have to file for it yourself. The Crown isn't going to help you with that.
 
So did you plead guilty to a lesser charge?

I was in court this morning for a speeding trial I hadn't received disclosure for. The prosecutor asked me if I would accept a lesser charge without points. I said hell no (ok I just said "no"). When I approached the bench a few minutes later I was informed the cop was a no show. Sneaky bastards.

I agreed to a "green light, fail to proceed as directed" rather than a 3 point disobey sign. I know I should always fight, and I was reasonably well prepared, but I haven't had a convinction in 12 years and a no-points $50 fine wasn't so bad. Anyway, the prosecuter told the court I was willing to plead to the lesser charge, then the clerk read the charge and asked for my plea.
I said "Your worship, to save the court time, I am considering my options. Before I make that decision, I need to know that the crown is ready to proceed, and I have not seen the crown's witness in the courtroom." Man, did that piss her off. "Of course the officer is here, sir! Do you think I would try to trick you?" "I don't know." Then the JP asked her to confirm that the officer was there before making the clerk read the amended charge again.
That would have really sucked, to plead guilty if the crown had no case!

Someone else in my courtroom plead guilty to the same charge, fail to proceed on green.
In my case, I absolutely HAD to win or have the charge thrown out otherwise it would've exceeded my 2 ticket grace with insurance lol. Another drops off in March so come spring I should have a bit of leeway again :D
 
Google is your friend. Took me 20 seconds to find a document outlining everything you need to know about tickets, fines, etc in Nova Scotia.

Sheesh. Some people just too lazy to do their own leg work.

Not everybody is a smart-allec like you, be thankful. I also know hot to use Google but prefer to ask humans so they can give me advice at the same time, also I don't have to wade through pages of trash links before I read what I need to read.
