So I got rear ended on the 401/400 south ramp :(

It would be rather difficult to prove intent. On the other hand an operation without due care and attention would be possible. It would be best if there were independent witnesses.

I have lost all hope for witnesses... When I was 18, about 4 years ago, I was heading to work near Dufferin and Steeles at 5:30PM (Rush hour). Small protege got rear ended hard by a BMW X5 that was driving beside me 2 seconds earlier and didn't hit his brakes when approaching stopped traffic in front of us. I pulled over to try and do what I could to help. Everyone else drove by while the dad was tending to his kid in the back seat whom was crying and bleeding from his face due to glass cuts (The trunk of the protege was gone from the hit and the back seat was folded inward where the kid was sitting). What did the rear-ender do? Nothing. He was picking up parts from the car saying f*** f*** f***. What did the 10+ people do at the bus stop beside us? Watch.

How did I become the only witness? I have no f***ing clue. I was ****** off at the fact that the rear-ender was worried about nothing except his car and that no one bothered to help. Luckily, police, ambulance, and firetrucks got there within 2 mins of the call and was able to control traffic and do their job.

I did gain a little bit of hope when I fell on my bike last year where an a man pulled over and came running to me when he saw me go down along with someone asking me if I was okay from their car.

What did you need help with? Two people tending to the one injured person, sounds better than 8 people tending to him, and everyone else passing by asking if they're OK and what happened.

Exactly. I know it doesn't always happen, but if someone was asking for help I am sure you'd find a lot more people would assist.

+1 It doesn't hurt to ask for help unless you have a broken jaw.
 
So just a small update, I've been very busy with work & helping out some buddies with their bikes.

I went to the hospital for some x-rays and there's swelling around some tissues in my foot but the doctor said "over time, it will heal" There's a small amount of pain but now I'm able to move my toes :)

I've spoken to two different people from State Farm, one from accident & benefits, the other property damage? Well they're going to contact her to get a statement & I have to wait a couple days or so for a call back.
GWS waiting for the results of the investigation keep us posted.

Point being, I was the only one that gave a witness statement as no one stopped and people waiting for their bus left. Would have been nice if someone directed traffic as well...

I would have jumped in and seen if I could help. Every time I see a rider on the side of the road, I stop and ask if they're okay.

I once saw a car that looked like it had been hit hard by another one facing the wrong way on the 407. I was the only person nice enough to stop and ask if she was okay. Apparently somebody hit and ran. I stayed by until the cops and CAA came. And of course, this was during rush hour where hundreds of cars stared or took photos like ****ing lemming.

I'd rather know I did something rather than wonder if I should have done something.
 
Maybe I missed it in all the pages here, but has the OP said what the cops can/will do about this?
 
I don't think it has anything to do with bystander effect. I make an assessment of whether anyone's in danger and decide to intervene or not. Stopping for every single biker or motorist on the side of the road regardless of the problem is ridiculous.
I've stopped twice to help people who appeared to need help, a crashed Jeep on the QEW and a bike breakdown on Dufferin. There is one time I would have pulled over but the rider was on the left shoulder of the 401 and I was in the far right lane. By the time I saw her it was too late to pull over safely. Just like stopping when there's clearly no need for help also makes things worse, not better.

The owner of the car that was hit came out while I was writing this all down. As far as I can tell it didn't help much because the accident occurred on private property and the driver of the car that hit and ran denied it. The police wouldn't get involved :confused:

I believe the owner of the car that had been hit was able to use the info to have her insurance company go after the other driver.

At the end of the day I believe in Karma. Help out where you can and hopefully if you are ever in need of help someone will be there for you.

Unfortunately Kharma waits for the next turn of the wheel of life. I prefer two other principles; revenge and justice. Wouldn't hurt to put this out by social media and see if anyone saw the incident.

Unless I missed it, I don't think the OP reported to police, despite all the advice in this thread. He/she is dealing through insurance only, IIRC.

So far as witnesses go, people are sheep. No one will step up unless everyone else is. I've seen a number of accidents where no one will do anything. The event in the states last year where people came running to pull the biker out from underneath the burning car are extremely rare exceptions to the rule.

Glad you got a plate #. Hope the foot heals fast. Feet are complex little things with more bones and ligaments than you can count.

Is Hit and Run a criminal charge? Hope so.

Actually, on Page 1 OP clarified that he did report the collision. For the next 5 pages everyone continues to instruct him to call them anyways.

Collision reports are different than police reports.

From what I read of what Kuma just posted, the OP clearly states that he called the POLICE and they gave him an event number, THEN after work he went to the collision center.

Ah! In that case, it just seems that TPS just isn't doing anything about it. Not exactly a surprise but disappointing considering the potential severity of the situation.
