I think you're misunderstanding something.. it's not a settlement.. you're negotiating a severance package.
Severance pay goes on your T4 and ROE.
The company will certainly report it.

Yeah probably got caught up in all the speak to lawyer posts and assumed they were going to fight for right for employment. Yes if they do take the severance from the company they would have to report it, as well as the company. But if they fight then the lawyer can move the money.

Also the settlement can be paid to your lawyer and then given to you, this can by pass our dirty gov taxing your settlement.

Not an employment severance or back pay settlement, the part you receive is added to your employment income in the year you receive it.

Settlements for tort, pain and suffering, defamation and punitive damages are generally tax free.
