I'm sorry, but I don't think the amount of rules you need to remember comes anywhere close to the volume of laws in the HTA. People comparing it to life or death, surgery and other ridiculous stuff are just being argumentative. The HTA is huge and very much open to interpretation, as is any law and why no 2 cases are alike. It's not like he did anything terrible and it was very much a "better safe than sorry" situation.

Some of you need to do a slight reality check. Here's a neat trick to go along with the doctor comparison: Go to your family doctor the next time you get a cold and get a prescription. Then go to another doctor for a second opinion. The odds you'll get two different conclusions and prescriptions is highly probable because each doctor will remember something different and think of a different drug to treat it. No job is exempt from misunderstandings or mistakes.

Life or death... Come on, really?
 
well i apologize for standing up for a child's safety instead of just leaving sarcastic remarks from behind a keyboard ;)i have a motorcycle and daughter the same age so it hit home on how stupid it was.as for the cyclists yes thats stupid too but it wouldn't have hit home as much.and i would much rather be a random hero then an internet ego anyday :d

A huge majority of motorcycles on the market come with a pillion seat from the factory.

For that matter, where exactly are you expecting the passenger to sit without one?
 
why do people expect cops to know every word in the HTA?

do pilots know every letter in the flight manual? do mechanics know the location of every nut/bolt in a car he's working on? heck, does the prime minister remember the names of mayor in canada?

Ummm if this cop doesnt know the law then why the hell is he stopping people and lecturing them on non-existing laws? Does a mechanic make up a random non-existant car part and tries to order it on the phone?

hmm,, well , when one thinks of a "pillion" ... it sort of refers to behind the driver.. and in the post you quoted, but snipped... I said my young passengers rode in front of me. leaning against the tank... feet on their "foot pegs" with a helmet that fit... I guess if you limit your thinking to cruisers , or sport bikes.. instead of say old school CB350 honda style seats, or the XL600 that I refered to... then it would make no sense at all to try to carry a kid in front. Today I am on a solo seat, so when I take a passenger,, she has to sit on the fender.. no P.pad at all... just foot "pegs" and a helmet. they all scream that they LOVE IT!! so.. go with it! eh? :-)
 
^^^ cause he probably thought the act looked unsafe... and was trying to protect the children! then he found out, he didn't have a leg to stand on re age in the hta.

Woohooo! I agree with Peg completely.

We may not reasonably expect a cop to know all the laws BUT they should certainly know what the specific provisions of the law are before they try to enforce them.

You shouldn't be riding with a passenger in front. How do you expect them to hold on in the event of a hard stop? And they shouldn't be riding on the fender for that matter either. The only right place for a passenger of any size is on the rear seat. That included my CB400T and my CB750 which have seats as you describe. The passenger goes on back; that's where the pegs are. Pretty simple I thought.

I wouldn't call it argumenative, I think it provides good debate. Fortunately we have the freedom of our own thoughts and opinion that can sometimes be discussed in a mature manner, even on the internet at times

FWIW: my opinion is based on the last time I was pulled over, by an officer that really didn't know what they were doing, it cost me several hundred $'s for court because they chose to make up what they thought was wrong based on the lack of knowledge they had of their job.

When I took my pilots license 6 years ago my passing rate was 90% and I got 98% and it's not even my job... maybe cops should study the HTA more or take a refresher course, I have been pulled over numerous times for things that they 'think' is wrong when really... they just don't know better.

what happened to the other 2%?

thank god you didn't become a pilot, cuz i would not get on a plane unless the pilot got 110% *sarcasm*

I consider this child abuse to put small children at risks on the back of motorcycles and I have a small child. This is just plain stupidness, irresponsible and sooooo unnecessary and not to mention preventable-Ty have a nice day, They get my vote to pass this Bill, what's unfortunate that a law was necessary to protect the children because adults can't make common sense decisions in the best interest of the child.
 
You guys are awesome!!! Yes every cop should memorize the Criminal Code of Canada, the Provincial Offences and all By-Laws in order to do their jobs... yea ok....

Cops can't know everything and I agree if he thought something was wrong he should have stopped the guy then called someone to verify... Its ok to do the stop if he reasonably believes a law was being broken. I used to do loss prevention and we used to recite the law to the cops cause all we do is arrest for theft so we know all the details completely, where as the cops deal with everything so it's imposible for them to know every single detail of the law. Lawyers don't even know the law....they look everything up and have people looking stuff up for them....

Because that's what cops do, that's why they became cops, because they think they are above regular citizens and know whats good for everybody, they are the mommy and daddy of us simple peasants or as they call us "civilians".
