Ok, so lets make it detailed just for fun. Again, this is all made up off the top of a buddy and I's head.
So person is on his way home on his bicycle, sees police, and makes it to the side of his house (in order to get to the backyard to put away the bike), aka the person is parallel to their porch (about 10+ feet from the sidewalk). The cop asks for identification, and so the person gives them their ID (lets assume the cops walk onto his property at this point, maybe they don't though, maybe they just walk on up to the person and then ask for id, any different???). They then ask "can we look into your bag", the person says no you may not. They then search said person without their consent.
They find, lets say, drugs. Regardless of whether it was drugs it was not tools or weapons etc (maybe like a pipe with residue or some weed or something who knows, nothing that can be associated with what they were looking for).
They tell the person that they fit the description of " a man wearing black pants and a hoodie with a dufflebag"
The person is wearing black pants and a hoodie, but has a brightly coloured backpack, not a dufflebag, and is also wearing a lot of other clothing (like a jacket and hat or something etc).
They put them in handcuffs, take them in, process them, and then after a while let them go. They say they aren't charging you with 'possession' but you still have a court date that you must attend.
Is their grounds to protest something that happened?
Can someone have a court date but not be charged? What would happen in court if they weren't charged with anything?
Is it still too broad? It's getting hard making up all these 'little details' lol
