Police Officer Blatantly Lies In Court Against Me Today

I am also curious in the source and rationale. As I am unaware of any prohibition.

I'd be interested as to whether or not this was actually a "Lawyer" or a paralegal. Not to say anything bad about paralegals but I expect a LOT more from one than the other.

Also as far as I'm aware there is nothing out there preventing you from recording police executing their job in public. They wear name tags and/or badge numbers for a reason. So long as you're doing it in a way that doesn't make his/her job harder to do you're good.

Nope it's another one, I will try to find the links for the other 2 tickets, this one actually came to trial and the cop showed up, this was the biggest victory of all because the judge believed me and not him.

The judge said that I did my due diligence by putting the seatbelts on everybody at the beginning and that the only reason he believed my story was because the cop himself noted that all other kids were buckled, including very young ones and that there was no reason not to believe I had not buckled him up in the process.

Its not that he believed you its that there was reasonable doubt because of the buckle in the picture I would guess.
 
So, was there a kid standing in the backseat or not? Also if i read this correctly, this isn't the first time this has happened, is this true?

He might had been standing, that's besides the point, am I really guilty of a crime that happens behind my back without my knowledge? Just think about it. This judge is an excellent judge because he saw this.

I responded; "No you worship, I saw the cop following me for 2 city blocks in my rear-view mirror and if I would have seen this kid standing up from his seat I would have seen it in that same mirror and I would have pulled into the nearest parking lot to avoid a ticket, but since I never saw this kid standing up and I knew I had buckled him down I proceeded to drive without worries for another 2 city blocks".

The judge nodded in agreement and said "I see".

Wait a second here... in your initial post you tell us you noticed a cop tailing you. Correct me if I'm wrong. How did you know this? Probably with the use of your rearview mirror, correct? Which you pointed out in your above post as well! If so, how do you not notice a child standing in your van in that same mirror? I call BS. You're guilty.

So you were looking at your rear view mirror the whole time the cop was behind you? Of course not, and I'm sure a judge would figure out that at some point you had to look forward and the kid could have stood up then.

You had a kid without a seatbelt AND a baby without being strapped in, in two different situations.... what the **** is wrong with you?

It would appear that, ion both cases, there was an adult in the back. It could be that the judge placed the onus for taking care of the child on this adult, thereby mitigating the driver's guilt. Also, because of recent rulings an officer's word counts for no more than that of another witness.

I'm a judge, and based on your post history you are guilty of everything you're accused of.
 
Gentleman I need some help here for a similar ticket I got yesterday, the most importent reason to get it off is because i got an interview with TTC and the job requires a clean slate, i already have 2 tickets which is the max number they will entertain for an applicant plus it wasn't my fault. Here is what happened

I picked up my 2 friends from thorncliffe, one friend had to bring his daughter with him whom he secured on my daughter's seat just behind me and sat with her. Moving forward I noticed a cop car behind me at overlea and thorncliffe. I changed lanes and he changed lanes as well, i did a left turn on don mills north coming from overlea and Once the turn was completed the cop turned his cherries on and I pulled over to the right. 2 cops approached us from both sides, one on my side told me I seemed in a hurry, was going fast and was changing lanes quickly. He asked where was I going and asked for my insurance, license and ownership. He took the ownership and immedietly verified the numbers on the lower left windscreen. It seemed he thought i stole the car or had something illegal on me. During this time the other officer asked my friends for ID and both of them didn't have theirs. He started flashing his light inside the car and saw my friends daughter unfastened. He said why isn't she fastened to which my friend replied I was changing her and had to take it off for it. They proceed to push my friends for ID and the cop taking my ID asked me of I was told I was being recorded, I told him I wasnt informed of that. He told me I will get a ticket for not having the baby(4 year old) secured. I told him my friend just told you he had to change her. The other cop started flashing the light in the car and saw my yellow poloroid camera on the floor, he asked what was it and we told him it was a camera and he asked me if he can have a look at it to which we obliged. He looked at it carefully, tried opening it and then asked me what was it, i told him it was an old poloroid camera. After this they left for their car and came back 10 minutes later with ticket which stated.

Did commit the offense of: fail to ensure todder(toddler) properly secured

Contrary to: HTA o.reg 613 section 8(3)

Fine 200 payable 240

Even when the girl's father owned up unfastening her, they still gave me a ticket. Advise please
 
Freak your ticket is easy to defeat, take the adult and his child to court on that day and plead not guilty let him explain to the judge that he himself took the seatbelt of his child I got off this ticket even without help from the child's mother.
 
Did your super duper, crime fighting paralegal not ask for disclosure prior to trial?
If he had he should have received a copy of the officer’s notes plus his name a badgenumber. Then today all you would have had to do was ask the officer, after histestimony, to identify himself. Easy peasy, the JP would have fallen all overthe place to stop the proceedings. Last thing any of them want is for an officer to be caught in a lie.


I beat a bogus 20 over speeding ticket by embarrassing the officer and the crown attorney in a similar, two cops only one shows up, situation.

Hi and sorry for the late reply, yes my paralegal asked for disclosure but only got it that same day he asked for adjourment but we both decided to go ahead that same day because we felt we had a strong counter-case. Also we did not know the cop was impersonating another cop until the trial started. I also defaced the cop in the trial didnt you read my original post? The judge just brushed it off when I told him.
 
Hmm interesting. I wonder if this is way different than just audio recording (aka on your phone). Cause when I did record a cop on my phone (just voice recording), tried playing to my lawyer.
His first question was: "Did you let the cop know that you're audio recording him?"
Me: "No"
Lawyer: "Then you can forget about this "evidence" ".

In that case "it would appear that" the justice erred on the decision.

So should I hire a paralegal or do it myself? I will be filling out a form for the disclosure as soon as I get the date for it. The father admitted to taking the child's seatbelt off to change her and it must be on tape. Will the father get the ticket instead? Or would this be thrown out as the ticket was issued to the wrong person?
