Hi guys, today was another great victory, the 3rd ticket I have fought successfully in great part thanks to a paralegal ticket fighter that's top-notch whom I have hired for all 3 tickets. This ticket was "Fail To Have Child Secured", "No Belt Seat Assembly" for $250 dollars and 3 points, also it would had been added to my insurance record and pay more money monthly for the next 3 years.
Here's the rundown what happened on January 2012:

-Went to pick up my son from a soccer game along with 3 other kids and their moms.
-I told everybody to put their seat belts on and one of the single moms helped me buckle everybody up.
-Was going north on Jane St. (Toronto) when I noticed a police cruiser trailing behind me. He followed me for 5 blocks and put its cherries on, pulls me over.
-One cop walks up to my window and asked me for my documents and asked if all the kids were secured, I said "Yes sir they are". The other cop stays behind the minivan.
-Cop told me that 1 kid had been standing up in the back seat so that's why they stopped me, I said "No way, I secured them all" and the cop says he was going to take a look inside, sure enough one kid is not secured and turns out that he had undone the seatbelt himself while his mother sitting beside him did not noticed (or didn't care).
-Cop tells me that there's not even a seatbelt assembly, that the buckle is missing, I again said "No way" that I always carry kids in my minivan and I secure them myself, only a few hours before I had secured my nephews. The cop is adamant and gives me the ticket anyways.
-I drive 3 blocks to a Petro-Canada station and get out of the car and search and sure enough I found the seatbelt buckle under the seat, the kid had not only taken his seatbelt off but also took the buckle out of the harness. I was ****** off at him and his mother. I buy a Toronto Sun newspaper on that day and take pics of the seatbelt buckle under the seat along with the newspaper, it had a headline on that day that read; "Father Knows Best" and a picture of Dalton McGuinty carrying 2 cases of a beer.
Forward to today and it was court date, a cop was there with the notes taken that day which didn't said much, just that he stopped me because a kid was visible standing inside the minivan. here's the thing, that cop was NOT the cop that gave me the ticket or dealt with me (it might had been the partner that was always on the sidelines that day). Here's the shocker; while at the trial the cop swore on the bible and claimed he was driving "solo" (alone) when he saw me, "I was patrolling alone that particular day in january". Bullcrap! There were two cops that day and he is not the one that was driving nor the one that dealt with me, he just stood about 15-ft behind my van and never searched it or even talked to me. At the trial he claimed he searched my minivan and never found the seatbelt buckle under my seat.
I told the judge, "He's not the one that stopped me, nor searched my car, nor the one that gave me the ticket, sir!!"
The judge said; "Well don't worry about that just tell me your side of the story, that's what counts here." WTF?? Really?! Just brush it off like that?
Anyways I told my side of the story to the judge and told him I had pictures from my cellphone just 10 minutes after the cop left that he seatbuckle was under the seat and that the kid in question had unfastened himself while on the road, that my responsiblity ended when I made sure he had it on, I could not be watching my passengers every 5 minutes while I'm on the road.
Finally the judge says; "Okay that's enough I heard enough evidence. I believe the police officer in everything he says, and believe in his integrity, but I also heard your story and how you had numerous kids in the car and the only one unbuckled was the one with the missing easier-to-remove buckle lock, in the sake of justice I just simply cannot proceed with this trial, case dismissed"
