A terrible and tragic situation and I wish the survivors the best as they recover.

I notice the article indicates that the drivers prior conviction resulted in probation and a fine after the original charges were reduced. He has not yet been officially charged for the current situation as the blood tests have not been returned yet.

NOPE You misread:
Back in 2009, he was arrested for a similar offence and was giving a yr probation and a $1040 fine.
The case involving the Canadian couple has yet to be tried.
